California Mom Drove Teen Son To Gang Fight, Found Guilty

LONG BEACH, Calif. (AP) -- A mother who drove her teenage son and his friends to a fatal fight with a rival gang in Southern California has been convicted of second-degree murder.

The jury convicted 31-year-old Eva Daley on Monday. The jury also found that Daley and her co-defendant committed the crime for the benefit of a criminal gang.

Heriberto Garcia also was convicted of second-degree murder. He was accused of stabbing 13-year-old Jose Cano in June 2007 near a Long Beach skate park.

Daley's son and four other youths pleaded guilty to manslaughter and were sentenced as juveniles.

Several witnesses testified in the March preliminary hearing that Cano also attacked Daley's son, Mauricio Rivera, on Dec. 4, 2006, stabbing him, the prosecutor told jurors.

A 15-year-old boy charged with killing another teen resorted to murder to avenge the death of his younger brother last summer, sources told the Press-Telegram Wednesday.
Eric Benitez, 15, was so incensed by the stabbing death of his 13-year-old brother, Jose Cano, that he turned on Cano's fellow gang members, killing 16-year-old Florentino Rivera, who may not have been the intended target, according to several sources who spoke with the Press-Telegram on condition of anonymity.

The real target was an 18-year-old member of the East Side Longos who was with Rivera when the 16-year-old Cabrillo High freshman was gunned down Jan. 6 while riding his scooter near 15th Street and Cedar Avenue en route to visit his sick mother, she and another anonymous source told the Press-Telegram.
