U.S. District Judge Harold Baer Jr. handed down the order late Wednesday in New York. The AP lawsuit already has led to the disclosure of previously unreleased flight logs from Bush's days piloting F-102A fighters and other jets.

Pentagon officials told Baer they plan to have their search complete by Monday. Baer ordered the Pentagon to hand over the records to the AP by Sept. 24 and provide a written statement by Sept. 29 detailing the search for more records."

23. This is one instance in which I don't think they can get away w/an appeal
Bush has promised to release all of his documents - in fact, he claimed that he had already released them.

It would be a BIG mistake, in light of this, for them to go to court to try to block the release of any of the documents he already promised to turn over less than two months before the election - especially with AP as the opposing party. They're having a hard enough time fighting CBS - the last thing they need is to have the Associated Press coming after them.

escalated this far. First by smearing Kerry relentlessly and then attention going to bush's non service and the veracity of the memos..Aren't they the ones who deserve the credit for this 30 year ago explosion?

7. Cool article- Great the story is staying in the forefront
I like that the forged document issue is not mentioned in this article and the last sentence about how guardsman could make up missed drills (Since we know AWOL never did the time OR any makeup drills either!)

12. Actually...
... there are strict rules on making up missed drills--and on how drills may be done at locations other than one's home base. As I recall, the time limits were up to two weeks in advance, or up to 30 days after the missed drill. Many of the drills listed in Bush's record (and there's still some question whether Bush actually attended, or was just credited with inactive reserve time for scheduled drills he didn't actually attend) are outside of those limits.

And, one had to get written approval to do so. Haven't seen all those written approvals in Bush's records, either.

Doesn't really matter, though--there are enough gaps in the record that the WH has put out to generate more questions than answers. And, there's that sticky matter of failing to take his physical--twice. (Everyone says he "missed his physical," but that's not accurate. His last physical was May, 1971. He was supposed to take a flight physical one year later, May 1972 (and no later than his birthday), and his next anniversary date would have been May, 1973. So he skipped two of them....)

All the excuses made for why he couldn't take his physical in May, 1972 (wasn't in Houston for his personal physician, Alabama didn't fly the planes he could fly, etc.) didn't apply in May, 1973. And he didn't take his physical, then, either.

In 1999 and 2000, the press bought all these excuses (one of the very good reasons why it's not unfair to call them lazy). if they ignore it all this time around, then they are consciously looking the other way. Bush skipped out on 31 months of a 60-month agreement to fly for the ANG. Skipped out on his responsibilities to the country--just as he's done for the last 3-1/2 years....

WHAT???!!!!!!!!! Haven't they been ordered twice before to do this under FOIA? Or were only specific documents sought previously?

Does anyone really believe that the Pentagon thumbed its nose at him when he supposedly instructed them to turn over the documents?

In 2002.... In a victory for a Ku Klux Klan group, a federal judge on Tuesday ruled that a New York state law violates the U.S. Constitution by barring public demonstrators from wearing masks.
The city said it would appeal."

March 1996....Judge Howard Baer, Jr., a Manhattan U.S. District Court jurist and Clinton appointee, set off a storm of criticism when he ruled that 80 pounds of cocaine and heroin found by police in a car could not be used as evidence. (Improper search and seizsure)

They are above the law. Remember? I'll bet they do something to get out of it. Appeal, go to the SCOTUS....Cheney didn't have to release his secret Energy meetings reports, we won't get those records.

Still no DD214. I read yesterday that AT LEAST 8 copies are made and filed in various different places. We aint seen a one. Pfft.

21. Just from past fascist behavior,
they won't do what the court ordered. It started with the Florida Supreme Court and hasn't stopped since. The assholes can do anything they want. They are in total control of this country. :(

25. This is very different than the Cheney case . . .
Cheney never pretended that he was going to give up the documents - he stonewalled from day one, insisting that they were nobody's damned business.

In this instance, Bush not only promised to turn over ALL of his documents, he has repeatedly claimed that he already HAS turned over everything. Given that, he would have a hard time getting away with fighting this court order in order to avoid having to turn over the documents he promised to release. Even the whore press would call him on it.

27. Interesting info about Judge Baer . . .
Judge Baer, a Clinton appointee, announced recently that he plans to take senior status early next year, which means that his seat will become vacant. Normally, the president who is in office when the seat actually becomes vacant nominates the successor. But Bush jumped the gun and actually nominated someone to fill the seat that Judge Baer HAS NOT EVEN VACATED!

And, even though, in the past, the Senate has never considered, much less confirmed judges in the fall of a presidential election year (recognizing that a new president may be in office in January), the Republican Congress is trying to force a confirmation vote within the next few weeks.

So, not only did Bush shove his right wing judges into the openings that the Republican Congress would not let Clinton fill during his term, he is now trying to further stack the courts by filling vacancies that should be filled by the next president.

Of course, hardly anyone knows this because the press is too busy beating up on Dan Rather.

Bush may get away with this latest abuse of power, but in the meantime, Judge Baer is still on the bench and he put a whoopin on him today.
