Obama-birthplace lawsuit in O.C. plagued by infighting (Taitz update)
Edited on Tue Sep-08-09 07:34 PM by Catshrink
I sure wish I could post more than 4 paragraphs of this:

Obama-birthplace lawsuit in O.C. plagued by infighting

In the federal lawsuit claiming that Barack Obama cannot legitimately be president, today’s hearing in Santa Ana focused not on documents that allegedly prove he was Kenyan-born but on the conflicts of plaintiff’s attorney Orly Taitz.

Judge David O. Carter dismissed Taitz’s motion to have two of her clients removed from the case and also tossed her motion to have Magistrate Judge Arthur Nakazato removed from the case. Carter said there was no basis in Taitz’s complaint that Nakazato was biased against her in an earlier administrative ruling.

Additional, Carter told Taitz that she had no choice but to work with Gary Kreep, the attorney now representing the two clients Taitz wanted removed from the case. Taitz had said she would not work with Kreep because of past conflicts between the two, and because they viewed the case differently.

<sip>

Carter then called a 15-minute recess, and directed Kreep and Taitz to step into the hall and figure out a way to work together. Kreep went into the recess agreeing to work with Taitz and returned with the same position. But, “Ms. Taitz said there is no way she will work with me,” Kreep told Carter when proceedings resumed.

1. When are they going to declare this woman a vexatious litigator
and bar her from ever bringing a case in front of a judge again?

2. You've got to admit, she's pretty entertaining.
Although part of me is embarrassed to watch her melt down -- the human decency thing that separates us from RW Republicans.

10. Only laypersons can be declared vexatious litigants in CA. The legal definition
is someone who, without legal representation, files X number of failed lawsuits within X time. Etc.

I don't think the VL law can be used against an attorney. Perhaps abuse of process might work in a bar complaint.

12. She already has a bar complaint

In April, a formal complaint was filed in the California bar against Taitz. Among the allegations in the complaint:

-- Taitz is indiscriminately hurled charges of treason and called for an armed revolt against the federal government.
-- She actively recruited clients in a state where she is not licensed to practice law.
-- She has repeatedly disrespected judges and officers of the court.
-- She has made false and misleading claims in court filings.
-- She has not properly accounted for money she has raised to further her crusade.

The complaint has been filed anonymously, the author claims, due to Taitz's history of retaliating against her critics.

20. Rule 11 sanctions seem appropriate, however.
I assume she's the one who signed the complaint, the frivolous affidavit of prejudice against the magistrate judge, etc.

25. Amen!
Lawyers get threatened with that every day, so why is she getting away with this!

I despise Rule 11, it simply hands power over the judges, but so long as it exists, use it on this lunatic!

He was eventually disbarred for filing so many frivolous lawsuits.

21. I didn't know Phelps was a lawyer.
I seem to remember that his daughter was or another member of the family. Is he a Baptist minister or just a member of that church. Is it Freeport Baptitst Church? My memory is crap this morning.

26. Westboro Baptist - they're all lawyers, and that's the game...

The entire operation is a con job. They get people angry enough to assault them, and then sue them.

29. Yes the whole family is made up of lawyers
Most have been disbarred, like Fred.

Yes he's a Baptist minister but I don't think his church is affiliated with the Baptist church anymore.

14. Let the Freeps take it seriously and prove what hypocrites they are.
Because Oily obviously wasn't born in this country, but I'll bet they wouldn't care. She's white, just like McCain.

This is why I can never be bored with life, and why I need to give up writing fiction. The best stuff I make up could never equal the random irony of Truth and Reality.

28. Yep, Gary Kreep
Uber-Fundie in San Diego county. Defended a couple people who confessed to firebombing a birth control clinic, and later ended up owing Planned Parenthood a pretty big chunk of change.

He wants to be a big name in the theocon movement.

DefendGlenn.com Founder Gary Kreep Also Defender Of Nativist Radicals

Gary Kreep, head of the United States Justice Foundation and founder of DefendGlenn.com is a professional when it comes to defending the racist and bigoted actions of America’s radical right-wing. Aside from spearheading the creation of a website aimed at spreading smears about Color of Change and White House official Van Jones in defense of Fox News personality Glenn Beck, Kreep has also supported the hateful interests of nativists, homophobes, and anti-choice radicals.

After Beck called President Obama a “racist” with a “deep-seated hatred for white people,” Color of Change and its Co-Founder Van Jones convinced 46 companies to cancel their advertisements aired during Beck’s show. In response, Kreep then founded DefendGlenn.com. Kreep himself subscribes to the delusional notion that Obama “has been hiding the truth from the American people.” He has also expressed frustration about recent waves of immigration to the US, having told the Los Angeles Times:

“When the Italians came to America, they assimilated. When the Irish came to America, they assimilated…It isn’t the language barrier; it’s the willingness to assimilate. It’s not that hard to come here speaking only a little English and assimilate.”

In 1992, the gay community and the Anti-Defamation League expressed outrage when Kreep brought his “purportedly anti-homosexual views” to San Diego’s Human Relations Commission.
