The career low-level spooks that carried out Bush/Cheney torture policies are NOT the target here.

By telling the CIA grunts that he and Holder have "got their backs" today, Obama will get MUCH more cooperation from them when it comes to landing the big fish.

And the ultimate big fish in this, Dick Cheney, just lost a layer of protection.

Some of these CIA grunts are still in the field. Charging them for doing what the CiC directed them to do brings them out in the open and puts them and their families in danger. Remember Valerie Plame?

If the CiC defines waterboarding as NOT torture, and then tells low-level interrogators that they have the green light to waterboard, then the low-level interrogator is not and SHOULD NOT BE the target here.

1. agree
having seen several documentaries, the behavior was dictated by orders from above. start at the end, go up the trail to the top, begin there.

2. That's like saying the
troops should be prosecuted for the illegal war (that argument has been made).

After all they knew it was illegal.

Prosecute the architects of the crime.

5. Yep, that's what I'm thinking.
If ANYONE get prosecuted ... by us or the Congress or Spain or whomever .... it will be the big guys.

I'm not convinced that I disagree with the "just following orders" line of defense. I dont see it as cut and dry as others do.

7. I agree with you.
I remember back during the previous administration, we we re told over and over and over again... "it was Just a few bad Apples" -- those bad apples went to jail. No one ever bothered to look at who poisoned those few bad apples. No one went to jail for giving orders that people carried out. The only people who went to jail were the low lying fruit from that bad apple tree.

8. Yep. That's why the Obama administration is being smart about this
no matter how much righteous anger folks are mustering.
