claiming executive privilege as Clinton and Bush did. i am sure their White house counsel and Attorney general said they were constitutional in the exercising of it. Also there is great debate as to whether Obama can waive Bush's claim of executive privilege.

As per the book, "Presidential Secrecy and Deception: Beyond the Power to Persuade" by by John M. Orman, a sitting President may revoke the claim of executive privileged made by a previous President.
