Berg's LATEST Lawsuit......

Well, Batshit Crazy attorney Philip J. Berg has Yet Another Lawsuit, this one on behalf of a retired Colonel, One Gregory S. Hollister of Colorado Springs, and filed with co-counsel Lawrence J. Joyce, Esq. It was filed in Federal Court in the United States District for the District of Columbia, and is Hollister v Soetoro. Yes, Soetoro, as Berg is saying:

"Berg today, with co-counsel Lawrence J. Joyce, Esquire, filed another lawsuit in Federal Court in the United States District for the District of Columbia on behalf of Retired Colonel Hollister against Barry Soetoro a/k/a Barack Hussein Obama demanding to know Obama’s real name and if he is constitutionally qualified to be President. Plaintiff, Gregory S. Hollister, is a resident of Colorado Springs, Colorado and Hollister has “standing” and needs a decision so he knows whether or not to follow any Order of Soetoro a/k/a Obama."

Berg rants further saying:

"Berg stated, “I am determined, on behalf of the 320 million citizens in the United States, to see that “our U.S. Constitution” is followed. Specifically, in the case of Soetoro a/k/a Obama, does he meet the constitutional qualifications for President ? I do not believe so based upon:
1) Obama was born in Kenya and because his mother was not nineteen <19>, he was only “naturalized” and therefore, not qualified to be President;
2) Obama was legally adopted/acknowledged in Indonesia at the approximate age of six <6> and attended school as “Barry Soetoro,” for four <4> years – Indonesia did not have dual citizenship and to attend school, he had to be adopted or acknowledged and he became a “natural” citizen of Indonesia;
3) when he returned to Hawaii at age ten <10>, there is a question if he returned through U.S. Immigration – (a) if he did, Barry Soetoro would have been given a “Certification of Citizenship” that would have indicated he was a “naturalized” U.S. citizen since he was a “natural” citizen of Indonesia; or (b) if he did not go through immigration, which I believe, then Soetoro a/k/a Obama is an illegal alien and therefore, not constitutionally qualified to be President and his three <3> years as an U.S. Senator were a fraud.”


Berg could give a rats ass about the Constitution, or reality for that matter. His first lawsuit was strictly intended to try and force the DNC to ignore the primaries and select Sen. Clinton instead. It's only after Obama won the election he started spewing the right-wing "constitution" argument.

And who IS Col. Gregory Hollister (USAF, Retired)?

He was part of the regional leadership team of Colorado Veterans for John McCain.
Ran for city council in Colorado Springs under a plan to reform Medicare, privitive social security, and establish voucher programmes.
He also was tossing around plans to sue MoveOn.org for libel and defamation over their ad regarding Gen. David Petraeus.

Berg ended saying “I will continue my efforts until Obama either proves he is qualified or does the right thing and states that he is proud that he, an African American, received more votes than anyone else in the Presidential election on November 4, 2008, but because of things in his past, he must withdraw his name.”

The funny thing is this new lawsuit is it's an "interpleader", which related to property. Hollister has obligations and oaths due to his status in the Individual Ready Reserve, but these are not property. Berg seems to be grasping at straws here, since his argument in the complaint is

"Plaintiff is literally caught between a rock and a hard place. If reactivated, he comes under a duty to obey lawful orders. He would come under a duty, under at least certain circumstances, to disobey unlawful orders. He would come under a duty to support and defend the Constitution against all enemies, both foreign and domestic. But to whom will these duties be owed from January 20, 2009 on? And against whom will these duties operate? Soetoro or Biden?

This dilemma is particularly distressful to the Plaintiff in light of the current state of the law on obeying or disobeying unlawful orders. The Armed Forces themselves construe their oath to obey orders to require only that they obey lawful orders."


It sounds more to me like Col. Hollister doesn't like the idea of serving under a Democratic Commander in Chief, and Berg is using him as a "useful idiot".

*rolls eyes*

21 days left. I'm looking forward to seeing Berg and his birther friends get shot down - and watch their heads explode when Obama takes the oath of office on 20 Jan.

File 3 frivolous lawsuits within a 2 year period and your license to practice law gets revoked.

There was his 9/11 truther stuff...

Then he posted two open letters during the primaries demanding Obama step out of the race so that the "more electable" Sen. Clinton could get the nomination.....

Then before the convention, he filed a lawsuit taken mostly from various PUMA conspiracy sites to try and force the DNC to ignore the voters in the primaries and select Sen. Clinton..... (note - I am NOT blaming Sen. Clinton for Berg's actions. She's not responsible for every dingbat claiming to support her)

After the convention, he started getting more and more cozy with right-wingers that were pimping this stuff, and he's been spiraling downhill since.

There was no birth in Kenya, there is no "Barry Soetoro" and a baby born to an American in Hawaii is not "naturalized" - he's a natural born American citizen ... period.

Isn't there a law against filing the same lawsuit over and over again? :shrug: He just makes up shit to "support" a new argument to take the case back to court!

I'm REALLY hoping Berg gets nailed to the wall with Rule 11 violations soon.

His whole argument about "naturalization" is the claim that both Obama and his mother lost their US citizenship when she married Lolo Soetoro, (hence Berg's claim of "Barry Soetoro"), and therefore if he wasn't "Naturalized" when he returned to the US, he's an "illegal alien".

Actually Berg HAS a "whistleblower" lawsuit under seal right now in the Federal Courts claiming just that - that Obama is an "Illegal Alien" and should be forced to return his Senate salary. A lot of the birthers are also calling INS and DHS reporting Obama as an illegal alien.

Stupidity has no limits it seems......

I don't know if he's still using the "Canadian" birth certificate signed by Dudley Do-Right, but I wouldn't say that trying to position his case to get around the standing issue, and now seeking different relief, would count as "re-filing" the case.

He's got his original suit still in the Court of Appeals AND the Supreme Court.

He's got his "Whistle Blower" suit under seal in Federal Court, (that's the one where he's asking that Obama give back his Senatorial pay because he's not a US citizen)

And now his new lawsuit. So three active in various places. Dr. Orly Taitz is running two and trying to get active duty and retired military personnel for a third as well.

As far as "recycling evidence" goes, none of the proceedings have gotten anywhere near his "evidence".

don't have the Canadian BC claim. But a lot of the claims are word for word identical, (born in Kenya, fake BC, Indonesian citizenship, etc...)

In the case of his "whistleblower" Federal Court lawsuit, the supplimental "evidence" document he provided not only was word for word identical to the supplimental one he filed in his Supreme Court appeal, it even had the SCOTUS case number on it.

He claims to be a member of the NAACP.

On the other hand, since he started his lawsuit parade, he's been on an increasing number of far right internet radio shows, some of which have extensive use of Confederate Flags and the like. Maybe he just likes other races as long as they know their place...... (and it could be disgruntlement, since he was a Clinton supporter....)

Ironically enough, many of them are also anti-semetic and rabidly anti Democrat. Ironic because Berg still claims to be a Democrat, and is Jewish. I suspect his right-wing "friends" simply find him a useful idiot.....

In Berg's case, suing Bush, Chaney, and various Justices of the Supreme Court trying to get "The Truth" about 9/11

In Hollister's case, more than likely either cheering them on, or complaining that they're not conservative enough.

How else to explain his 320 million figure? The US Census Bureau says we're only at 305.5 million. So if they're citizens now, isn't this suit an own goal by making Obama a citizen too, thus eligible? I'm just trying to follow the illogic here... :shrug:

This is Billy Bob Tucker, and we’ve taken over the White House and several state capitols ( no one was injured during these raids ) and once again America is in the hands of “We the people”

We will hold NEW elections come Monday morning. Anyone wanting to participate should be at your state capitol 8:00AM.

I’ll take questions from the press now.

1…Where is the President?…… You mean Bam-Bam? He’s been exported back to Kenya

2…What caused this outbreak?…… We the people just finally got tired of being taxed to death, and we are tired of our elected officials “not listening to us after we vote them in”

3…What is going to happen from here?….Well, we’re going to start by restoring the Constitution that our elected officials have stomped, burned, changed, worked around, and just flat ass ignored to it’s original meaning. Then we’re going to bring God and Country back into the school systems (effective immediately ). Then we are going to make it a pre-requisite for all voters to take a 4 hour course studying the track record of the person they are fixing to vote for before they are allowed to cast their votes.

4…What about Islam and the Muslims rights?….F**K-EM !!! There asses are out of here!! There will be no Sharia compliant financing allowed in the United States and anyone trying to push that shit on us will be put in jail

Well, there you have it America! Looks like the people have finally stood up and taken back their country "


This seems to be their wet dream - and they don't understand that the vast majority of the people in this country simply don't agree with them.
