Obama to Palin: 'Don't Mock the Constitution'
http://voices.washingtonpost.com/the-trail/2008/09/08/obama_to_palin_dont_mock_the_c.html

FARMINGTON HILLS, Mich. -- Sen. Barack Obama delivered an impassioned defense of the Constitution and the rights of terrorism suspects tonight, striking back at one of the biggest applause lines in Republican vice presidential nominee Sarah Palin's speech to the GOP convention.

It was in St. Paul last week that Palin drew raucous cheers when she delivered this put-down of Obama: "Al-Qaeda terrorists still plot to inflict catastrophic harm on America and he's worried that someone won't read them their rights."

Obama had a few problems with that.

"First of all, you don't even get to read them their rights until you catch 'em," Obama said here, drawing laughs from 1,500 supporters in a high school gymnasium. "They should spend more time trying to catch Osama bin Laden and we can worry about the next steps later."

If the plotters of the Sept. 11 attacks are in the government's sights, Obama went on, they should be targeted and killed.

"My position has always been clear: If you've got a terrorist, take him out," Obama said. "Anybody who was involved in 9/11, take 'em out."

But Obama, who taught constitutional law at the University of Chicago for more than a decade, said captured suspects deserve to file writs of habeus corpus.

Calling it "the foundation of Anglo-American law," he said the principle "says very simply: If the government grabs you, then you have the right to at least ask, 'Why was I grabbed?' And say, 'Maybe you've got the wrong person.'"

The safeguard is essential, Obama continued, "because we don't always have the right person."

"We don't always catch the right person," he said. "We may think it's Mohammed the terrorist, but it might be Mohammed the cab driver. You might think it's Barack the bomb-thrower, but it might be Barack the guy running for president."

Obama turned back to Palin's comment, although he said he was not sure whether Palin or Rudy Giuliani said it.

"The reason that you have this principle is not to be soft on terrorism. It's because that's who we are. That's what we're protecting," Obama said, his voice growing louder and the crowd rising to its feet to cheer. "Don't mock the Constitution. Don't make fun of it. Don't suggest that it's not American to abide by what the founding fathers set up. It's worked pretty well for over 200 years."

He finished with a dismissive comment about his opponents.

"These people."

Edited on Tue Sep-09-08 04:03 PM by politicasista
There is no Dem surrogate (or arguably Dem) that has worked hard in having Obama's back than Kerry. It would be nice if Obama's supporters would appreciate that more instead of tearing others down to promote him. The times are different. This is now post Iraq Civil War, post Katrina, bad economy, lame duck president/vp, etc.

Kerry is doing for Obama what Dems should have done for him in 04. Same with Gore.

They did the same thing to Gore. Actually, they still do.

"if only Gore/Kerry had been like this in the election, I would have voted for him"

They give themselves a pass for not paying attention back then. Bright side: at least they are paying attention now.

74. he's really not as good in debates as he is on the stump. He's still
the smartest guy on the stage but he stammers a bit too much trying to formulate and frame his response. Rethugs simply spew their stump for every answer. It may not answer the question but it looks stronger than Obama formulating an actual answer.

I'm just saying I worry a little.....

105. Well obviously his problem is
that he actually thinks about his answers. What an unpatriotic thing to do. She said somewhat sarcastically.

But your point about simply spewing a standard canned response every time is absolutely spot on. That and not actually answering whatever questions are asked. What I hate about the "debates" is that it's not a debate in any true sense of the word. And there's almost no follow-up and no attempt to make the candidate answer the question actually asked.

Climbs back down and puts soap box away for now.

He didn't equate himself with a terrorist, but I will part company with most here about this being masterful. Talk about the constitution, please, fine, but did he have to bring it up in the context of protecting potential enemies?. This will be spun, spun, spun. I can see it now, Rush Limbaugh: Obama wants constitutional rights for terrorists! Yes, I know that's not what he meant, but damn. DO NOT leave the door open for the right wing media spinmeisters.

73. I think he is waiting for someone to pick
up on it, and then will ram it down their throats. I watched the Q and A and saw the whole context. He used it as one of a group., "They think they've got Mohammed the terrorist, and they've got Mohammed the cab driver." It was said in a strong defense of habeas corpus. I will admit it is risky, but I'm really proud of him for it, for putting himself on the side of justice and human rights, and for using himself as one more illustration. It is the sort of thing he will use in the debates. I don't deny that it is risky, but I love it.

54. That is true - he didn't equate himself to a terrorist
but the reading and listening comprehension of the entire RW spin machine sucks, too. I am not going to say this will be huge like the other poster, but the first thing I thought when I saw that part of the comment by Obama was, "Uh-oh!" At the very least, some unintelligent southerners may say, "wait, is there also a Barack the bomb-thrower???!?!"

The points were GREAT, but I hope he will avoid using his own name in future examples, because unfortunately, and due to the fact that so many in the US are so incredibly ignorant, his name already is an issue, without him making up a fictitious terrorist with the same name. He could have just as easily said "John the bomb-thrower" vs. "John the presidential candidate", and I think that the point would have been even stronger.

The RW spin machine is ALREADY calling him a Muslim terrorist because his name rhymes with Osama. Anyone who loves that logic will love this too. But who cares? You're not gonna get those types on our side anyway. This brings two stupid illogical points up. People's names don't reveal their actions and alliances, AND the Habeas Corpus point.

It will be another LAME GOP response and he can bring up "When are they gonna talk about the issues????" again.

We can't run around worrying about GOP smear tactics all the time, censoring ourselves and walking on egg shells. That has not served us at all in the past.

Means more to me than alot of other great things he's done. It has been too long since we had a President who was committed to the principles established in our Constitution - the document which is heralded by other countries as one of the things that makes the U.S. so great.

How it came to be such an object of hate and ridicule by the Republicans says all we need to know about them and their true feelings for this country.

40. "Don't Mock the Constitution" - brilliant. After the past 8 years, we've been waiting to hear that.
McCain/Palin IS more of the same. The same disregard, the same contempt for our Constitution that the present regime displays.

Obama was a Constitutional law professor. And his love for the Constitution is obvious.

Someone on the radio said yesterday that she didn't write the speech she gave last week at the RNC.
I guess they're trying to walk that speech back now.

Good luck with that!!

52. Palin's comment is proof that the Republican Party is Fascist
So she mocks due process, rule of law, and the presumption of innocence?

She seems to want a government where anyone suspected of being a terrorist can be hauled off without cause, kept in secret, and tortured.

Her position is that the US government should be a police state.

That someone in her position is saying this is absolutely frightening.

78. Obama must keep his message simple
I love Barack, but when I heard him on Olberman last night, he was way too long-winded. He needs to really tighten his answers on TV. He has to have 4 or 5 bullet points or campaign slogans for these TV appearances. This is what people will take from these TV interviews. He has to relate his points to their own PERSONAL lives. We have all the issues won hands down, but only if he can be clear and succinct. Even Olberman tried to give him that hint twice last night, but Obama went off again with long-winded answers. He has to aim his answers to the undecided. He's great on the stump, but on TV he is talking to a much larger audience. Come on Barack. This is our last chance!

130. I'm confused about that too. But it wasn't Atta's passport
It was Satam Al Suqami's. That's a common misconception.

Atta's luggage was found sitting at Boston's Logan Airport. In it was his passport, instructional videos on how to fly a plane, an international driver's license, a prayer schedule, and a letter detailing his plans for martyrdom. But Atta's bags met the fate of so many airline travelers' luggage. They didn't make it on his flight with him. In fact, his were the only bags that didn't make it on to Flight 11. What a truly lucky break for us! As a result, we had the evidence we needed to prove who was behind the plot.

97. Games at school
In the 8th grade, we played this "game" called "Brown Eyes/ Blue Eyes": for 1/2 the class people with brown eyes were treated like 2nd class citizens and the teacher was most rude, cruel and unfair to them. Nothing you said was listened to and you were unfairly called out and even laughed at.

Then for the 2nd half of the day the blue eyed 9and hazel and green) students became 2nd class.
It was an exercise in prejudice....and how arbitrary and awful it was.

(I was made to sit in the hall because I wanted to know why my right answer to a question was sneered at and the same answer by a Blue Eye was not. The Principal's secretary saw me in the hall and wanted to know what I'd done. I told her we were playing a game. She took me to the principal's office for lying to her. The teacher later had to come and explain! talk about your Habeas Corpus!)

Now they should do this with Habeas Corpus. Accuse a student of something and then do not let him even get a chance to explain. "If you're not doing anything wrong....." That argument would go right out the window.

As an attorney, I have seen this country go downhill in the past 8 years. I have pinned my hopes on Obama. But, I have little belief in the American people understanding Obama.

I also post on conservative forums. I shake my heads at their frothing over the 2d amendment (which I strongly believe in) and I ask them how they are going to be Johnny get your gun, when they are thrown in the brig as an enemy combatant, or have no rights under Habeas Corpus, or when the 4th amendment is stripped of all meaning under the Patriot Act? Foolish.
