Is the Jefferson Appellate decision a good thing?

The simple read out is that despite a warrant, the contents of the office of a member of Congress are considered privileged. That the FBI raid was encroachment on an important separation of powers issue.

Ok but what's to prevent a congressman from hiding ill-gotten gain in a freezer in his office? What about emails contain evidence of bribery or prostitution.


On the other hand what if the prosecution is a politically motivated vendetta by an evil vice-president?

6. The article I read didn't summarize the decision the way you did.

It said the judge said having agents read legislative documents was unconstitutional and ordered any returned to Jefferson. That's a no brainer. Doesn't matter if the documents are in his home office, regional office, or Senate/House office.

Any other documents are fair game; no need to say that explicitly, but by saying the legislative documents couldn't be viewed and must be returned, all other documents can be viewed and retained.

Jefferson's lawyers, and the usual Senate/House folk, are overstating the case, as far as what's said is concerned. Then again, just as the Executive is jealous of his authority and privileges, so the Senate and House are no less jealous. Jefferson's claim that he should have approved any document merely makes him the final arbiter--one far from disinterested in the matter, at that.

The problem is how an employee of the executive or judicial branches is to tell the difference in acquiring future non-legislative documents. I rather liked how the judge crafted the solution this time.

8. No more privileges

Bush has got me going with his executive privilege nonsense. No one is above the law. The plain fact is that he had "cold hard cash" in his freezer. We need to clean up DC once & for all no matter if it is a democratic or a Republican member. Lets do the WH Monday morning.
