In the Region Ruling due by Oct. 13 on Election Day suit
COLUMBUS: A lawsuit brought by the Ohio Democratic Party over how Secretary of State J. Kenneth Blackwell will instruct election boards to deal with Election Day-voting problems is advancing in court.
At a hearing Friday, Franklin County Common Pleas Judge Angela Phelps-White said she would rule on the case before Oct. 13.
The Democrats want to force Blackwell, the Republican nominee for governor, to issue directives to the state's 88 county boards of elections that establish consistent policies for election machine security, handling voting machines when they break down and dealing with long lines at polling locations.
The party sought a court order in September after Blackwell's office refused to issue the directives. The party maintains that Election Day problems are likely to occur and Blackwell is doing nothing to prevent them and protect the vote.
