Jack Cafferty - 2/17/06 - CNN - Situation Room

Cafferty: Seems like we are having this discussion about this judge’s ruling sorta of in the abstract as thought there is no precedent for what the judge decided.

The judge in effect upheld the ruling of the FISA court which says if you want to wire tap phones you need a warrant to do so. The court was created by Congress 1978 (I think it was) and the law of the land says get a warrant. The actions of the administration have ignored the law of the land in that regard so its not a discussion in the abstract, it is not hypothetical, there are laws on the books against what the administration is doing and its about time someone said it out loud.

This federal district judge ruled today President Bush is breaking the law by spying on people in this country without a warrant. The judge said the president is violating the first amendment to the Constitution, fourth amendment to the Constitution and the Foreign Intelligence Surveillance Act (FISA) (1978) specifically to prevent this kind of abuse of power. It was being done before, that’s why the FISA Court was created in the first place. So what does this mean? It means President Bush violated his oath of office, among other things, when he swore to uphold the Constitution of the United States. It means he has been lying to us about the program since it started when he has been telling us there is nothing illegal about what he has been doing. A court has ruled it is illegal and it means a 75-year-old black female judge in Michigan has finally stepped in and done the job that the Congress is supposed to do. Namely oversight of the Executive branch of government. But the Congress is controlled by the Republicans and they are controlled by the President and they have done nothing in the way of oversight. I hope it means the arrogant inner circle at 1600 Pennsylvania Avenue may finally have to start answering to the people who own that address, that would be us, about how they conduct our country’s affairs.

Seems bush started, a long time ago, to violate his oath. You know, the one he swore on not one but two (ill-gotten) Inauguration Days - and on a bible, no less. The oath is: "...to PRESERVE, PROTECT, and DEFEND the Constitution of the United States." Notice, if you will, beloved brothers and sisters, which verb comes first: "PRESERVE." Which, if I'm not mistaken, means not to muck with, change, or otherwise adjust or modify. "TO PRESERVE" means to make sure whatever the object is that you're preserving is NOT CHANGED OR FIDDLED WITH. It is PRESERVED. Left intact, inviolate, as it was when you first got there, like any good Boy, Girl, or Cub Scout is supposed to treat a campground at the VERY minimum. Which is ANYTHING BUT what this criminal schmuck has been doing.

Is that or is that not a high crime, or at least, a misdemeanor? DO WE INDEED tolerate a "president" who willfully BREAKS THE LAW?

Visualize IMPEACHMENT!!!!
And then go DO something about it!

6. Bush keeps saying his job is to protect us
but of course, it's not.

"I do solemnly swear (or affirm) that I will faithfully execute the office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States."

Thank you for saying what should be obvious to all. Bush has nuked our
Constitution with his claims to unrestrained power. Spying on us without a
warrant is intolerable, but it is his claim to unitary authoritarian power to
commit that crime (and others) with impunity that is truly devastating to our
system of government.

Given the gravity and urgency of the threat to our constitutional democracy,
members of Congress have a sworn duty to take immediate action to defend the
nation. To date, only a handful have responded to Sen. Feingold's or Rep. Conyers'
call to action.

Fear of political consequences cannot excuse those who are sitting on their
hands. We expect members of our armed services to risk life and limb to support
and defend. Why should we expect less from members of Congress?

Hearing a public figure tell the truth about the criminal surveillance program
should not be a momentous event. Tragically, these days, it is.

Dare I hope you do not remain a lone voice at CNN?

Have to admit I've let my cable go, too expensive for the little good I was getting out of it, but have read about your latest fantastic excoriation of the wannabe emperor's abuse of power. For years I have been warning and writing against this bunch (which installed itself by coup d'etat) and hoping for a day when We The People rise up with pitchforks and torches to reclaim our country.

I count you among the precious gems in the otherwise barren desert of brainless American conformity. We have so little real voice in the "mainstream" press, please keep it up, you are doing a real service and for that I thank you.

15. Admiringly - indeed! That would describe my assessment of your email
to Cafferty. REALLY nice. Concise, and EXACTLY what needs to be said. This needs to be said. People need to start hearing defacto permission, like this, to get mad enough actually to get off their duffs and do something. Like the "reclaim our country" phrase. That's what we MUST do. It won't just be handed back to us willingly. Do bush and the other bad guys sound even remotely like they'd be okay with relinguishing power?
