Desperate Mckinney sues Atlanta Journal for "libel"
Congresswoman Cynthia McKinney (D-GA) is suing an Atlanta newspaper for libel, after printing comments stemming from her run-in with police at the Capitol building.

J.M. Raffauf, her attorney, has filed charges against the Atlanta Journal-Constitution, editor Cynthia Tucker, and its publisher John Mellott following an article the paper ran on Sunday, July 30, 2006.

According to Raffauf, Tucker's editorial column "was untrue, defamatory and libelous" when it read "'she (the Congresswoman) slugged him (the officer) with her cell phone.' This false allegation is not supported by any witness or any other evidence. Additionally, Tucker is maliciously attempting to spin this into a felony by falsely alleging that she assaulted the officer with a deadly weapon."

If the statements weren't backed up with facts - she has every right to sue.

The AJC is the major paper in the area. If the editors didn't fact-check EVERY comment this guy made -- too freaking bad for them.

And if this was a white male candidate, you wouldn't see the word *desperate* anywhere in the headline.

So stop reading the GOP talking points here friend and maybe suggest your Republican friends in Atlanta to not cross into the open primary and try to knock out McKinney. Majette tried that and stayed there 2 years voting with Republicans most of the time, a huge blow to the Democratic Party.

Stood him up she did.

But I'm not sure why the centrists would be all gungho over him. He appears to be fairly to the left. Hence probably why they're not cheerleading.

Nevertheless I find that it's better to campaign for someone than against someone, as the public prefers to know what they're voting FOR, as they will be stuck with it for a while. Hence, why I stopped campaigning against Bush in 2004 and started campaigning for Kerry.

I wonder what those who don't support McKinney feel about her possible opponent. "Eh, he's okay"? "At least he's not nuts?" Now there are some fine campaign slogans, eh?

Grand juries don't acquit. They decide whether to indict based upon probable cause. Further, as I recall, there was a constitutional question involved in this matter. There was uncertainty whether she could be indicted as the incident, whatever it was, occurred while she was literally on her way to Congress.

I mean, actual proof, not a Cynthia Tucker column or some other third-hand account.

Can you read an evil accusation into McKinney's statement -- Bush planned September 11 attacks to enrich his daddy? Oh, yes, if that's what you WANT to read. But reporters are not supposed to play ‘Gotcha!' with such serious matters. If a statement can be read two ways – one devastating – then journalists have an obligation to ASK and probe, and certainly not spread an 'interpretation' as a quotation.

OK, let's break this down:
  • You reported that McKinney's lawsuit says the AJC misquoted her as suggesting that Bush knew in advance about 9/11 but did nothing to stop the attacks "so his friends could profit from the ensuing war."
  • You then say "the Left" praises her for supposedly saying this.
  • Then you ridicule McKinney for denying she said it.

Am I wrong to say that you are saying that McKinney said Bush let 9/11 happen on purpose? If so, we agree that she never said any such thing!

It was more along the lines of her ASKING Bush if he had foreknowledge of the 9/11 attacks, not accusing him of having knowledge. We now know what she was saying was right.

But this is just another example of incompetent handicapping. If McKinney doesn't understand the difference between an "article" and an editorial she might get a hint from a paragraph late in Cynthia Tucker's editorial: "But what changes to the "stinking system" has McKinney wrought? She doesn't have the prestige or power to pass a resolution in support of sweetened ice tea."

I think the readers can determine this is an opinion piece. By suing the paper she brings further attention to the editorial, which can only hurt her.

Tucker, editorial page editor of the AJC, obviously doesn't respect McKinney and unleashed that in Sunday's editorial: http://www.ajc.com/opinion/content/opinion/tucker/

I thought Tucker worded the editorial very carefully in regard to the episode at the Capitol: "When he stopped her, the officer said, she slugged him with her cellphone."

Note the words, "the officer said." That attributes the section, "she slugged him with her cellphone," to the officer's summation of events, not a description from Tucker herself.

That appears to be an accurate summation, hardly defamatory and libelous. Although I'm not sure if the officer used the word slug. There wouldn't have been an incident if the officer hadn't made that claim.

Also, Tucker followed that sentence with McKinney's allegation, complete with specific quote: "She denounced him for alleged racial profiling and "the inappropriate touching and stopping of me — a female, black congresswoman.""

You know how McKinney lost in 2002? A slander -- A LIE -- about what she said about the Administration's foreknowledge of 9/11 and 35,000 Republicans crossing over into the Primaries to vote against her.

Items that are stated as facts in editorials can be sued over if they are untrue. For example, if I write an editorial stating one shouldn't vote for candidate John Smith because he killed a family of four in a DUI and he didn't then I can be sued.

86. Big Money is really after McKinney on this
and the most right wing of Dems are helping the fight along here, trying to replace her with someone in bed with contractors and recieving support from Republicans and conservative Democrats.

It would spell the death of progressivism in the Georgia Legislature (Congressman Lewis is also progressive but he is not as fiery as he used to be).

They're trying to kill the Left, and much of DU is helping.
