In fact - it wouldn't be worth it for the election Bilbray just won. Bilbray is only winning a 5 month term for the remainder of that crook's term. In November, there is an election again between Bilbray and Busby (they've won their respective primaries). I suppose Busby could bring up his residency issue before then. But I actually think that in that district, such a legal move would backfire against Busby and cause some who voted for Busby to change the vote to Bilbray (and possibly, motivate other Reps. who didn't vote to vote). She already may have lost some votes due to misspeaking late last week - although she corrected it immediately, guess what got played on the Repug airwaves?
But isn't the issue with Bilbray simply that he doesn't live in his 50th district house much, despite the fact he owns it? This is the case with a lot of Congresspeople who spend a lot of time living in Washington DC. Although if he's spending the majority of his time in another CA residence, there might be something to challenge.
