I just sent this to Majority Report:


'm as disappointed as the next democrat, but we must remember that we are NOT stuck forever with Alito.

As a nominee for his previous position he told the committee that he would recuse himself if a case came before him in which he had a conflict of interest. When the Vanguard case came before him in which he had a large financial interest, as well as being on the board of directors, he in fact did not recuse himself and voted for the Vanguard position. This constitutes lying to the congress which is a felony carrying a five year prison term. If that is not a "High Crime and Misdemeanor", then nothing is.

If, by some miraculous happenstance, we end up with a democrat congress this year, then it becomes up to us to demand that he be impeached.



I believe that it can be done. All it takes is the desire, and the congress.

3. All it takes to impeach a Supreme Court justice is "bad behavior"
as defined by the House. Still, I don't expect to see that happen even if we get a Democratic Majority there.

There's only been one impeachment of a Supreme Court Justice in all our history, and the Justice was not removed because the Senate saw it for a partisan effort.

Once he's sworn in, he'd have to do some pretty egregious things to get anyone in the House to act.
