Hey, anyone here give a rat's ass about *'s confidentiality? He
said today that he would not give up Miers papers (a BIPARTISAN request) because it would jeopardize his confidentiality and "that's a red line he's not willing to cross." His tone was indignant as usual and he seemed very agitated.

That lying lunatic * and his evil regime could give the old Russian Politburo a run for its money in terms of secrecy. His arrogance pissed me off...again.

1. Isn't this maybe the escape hatch Dubya needs to
force Miers to withdraw?

Defiant about releasing the docs, Bush can then wink and nod at Republican senators to declare that they just can't support Miers without a look at those papers.

Faced with near-certain defeat in the Senate Judiciary Committee, Miers bows to pressure and steps aside.

and not to block her altogether, the filibuster would probably hold.

This issue is MUCH larger than George W Bush...it's about the presidency. And if you can't see the value in a president's aides (ESPECIALLY the White House Counsel for pete's sake) being able to confidentially give him/her advice, you are literally blinded by both hate and partisanship.

Congress is a separate branch of government...they can make all the partisan and bipartisan requests that they want. It doesn't mean the requests are valid or healthy for the executive branch.

I'm sure you sang a completely different tune when House republicans demanded confidential papers when the Big Dog ran the show. You would have been right then.

6. Well Jeebus, does it count that she didn't pay her license fee
so she couldn't actually practice Law in DC? So I guess there isn't any actual Counsel privilege there.

10. I used to give a rat's ass...
...but then the "principle" was discarded for Clinton's conversations with his White House lawyer -- remember? So this "principle" has already been compromised. Why should we now roll over for the good of the office, when the other side has never done so and will never do so. And anyway, there isn't much else to go on to get an idea of her legal reasoning. Give the Senate the documents, let the American public know -- or withdraw her nomination.

11. Yes, there is that. The Rethugs already disregarded the office
can't have it both ways. Besides, my comment isn't about the office it's about this specific pResident.

a) Bush withdraw nominee (as you suggest)

or

b) Senators show the slightest hint of backbone and deny her confirmation (provided she does the standard stonewalling in the hearings) based on a total lack of information about the nominee.

This entire argument becomes moot if Miers actually answers questions in the hearings.

I just don't buy into the "well, they did it" argument. It reeks of hypocrisy and contributes zero to the common good, which is something all responsible citizens should be foremost concerned with.
