what if the dems refuse to recess? Can bush still appoint bolton?

what if the dems refuse to recess? Can bush still appoint bolton?
If the dems stay over the break what would happen? Can we fill the chambers so that we will be represented at all times instead of having to recess so Bush can go aganst our will and appoint Bolton?

2. I'd say there would not be a quorum so no business could be conducted

quorum - The number of Senators that must be present for the Senate to do business. The Constitution requires a majority of Senators (51) for a quorum. Often, fewer Senators are actually present on the floor, but the Senate presumes that a quorum is present unless the contrary is shown by a roll call vote or quorum call.

If unanimous consent isn't granted, Frist will make a motion for the Senate to recess. This is non-debatable (aka it can't be filibustered). If 50 Senators vote aye, the Senate will recess.
