Statement by Senator Edward M. Kennedy on the nomination of Priscilla Owen:

"When there are so many qualified Republican attorneys and judges in the Fifth Circuit why would the President choose one whose conservative colleagues on the Texas Supreme Court repeatedly criticize for distorting the law and who the Houston Chronicle says is "less interested in impartially interpreting the law than in pushing an agenda?" Why choose someone who President Bush's own Attorney General has said -- on at least ten occasions -- has taken an excessively activist approach to the law?"

Do you think these repukes are going to let a little compromise get in the way of their agenda? The only chance we have to stop them is if the sensible repukes stand up and say no. How likely is that?

And they won't give up. My point was, that was why she was nominated. To force that sitatuion. That plan got derailed. They will try again.

If she did preside over an appeal, the case would be appealed to the SJC and remanded for a retrial.
