STATE OF FLORIDA

OFFICE OF THE GOVERNOR

EXECUTIVE ORDER NO. 05-74

(Executive Order of Reinstatement)

WHEREAS, on March 10, 2005, the Orange County Grand Jury returned an indictment charging John Hugh Dyer, Jr., aka Buddy Dyer, with unlawfully providing or offering to provide a pecuniary gain or other benefit to Ezzie Thomas in exchange for Ezzie Thomas distributing, ordering, requesting, collecting, delivering, or otherwise physically possessing absentee ballots in the course of the election of the City of Orlando, in violation of Section 104.047(1), Florida Statutes; and

WHEREAS, on March 11, 2005, John Hugh Dyer, Jr., aka Buddy Dyer was suspended from his position as Mayor of the City of Orlando, Florida; and

WHEREAS, on April 20, 2005, John Hugh Dyer, Jr., aka Buddy Dyer entered into a pre-trial diversion agreement and based on this agreement, the charge in the indictment for offering to provide pecuniary gain for absentee ballot possession or collection was nolle prosequi on April 20, 2005, thereby dismissing the charges upon which he was suspended; and
