1. There is nothing in the consititution
that says salvery is illegal.

I guess that means it was activist judges that made it illegal?

3. DU tells me that it was "code" for something else. . .
that is, against "slavery" of the fetus, for "equal rights" for the fetus. . .and that this reference resonates with Bush's fundamentalist "voting cells" across the country. . .

4. google "dred scott abortion" (without quotes) and see what pops up...
he was talking in code all right, but a code that was very familiar to the religious right.

8. Yeah, I heard that too, but that really feels like a stretch
Bush talked about abortion outright in another question and went tangentially around it again with the stem cell question. He has no need for subtle. It's not like Reagan and the place where he started his campaign appealing to bigots.

I mean, if "Dred Scott" was supposed to be code for "Roe v. Wade", does anyone really feel those "voting cells" would be smart enough to pick up on it?

If it was code for anything, I think it was targeted for the African-American vote. Remember Bush was the guy that said that Democrats haven't done anything for them lately. Well, I think it was a continuation of that. Plus, referring to it as "Dred Scott" avoids jeopardizing Bush's bigot vote. Bush has the bigot vote wrapped up and would be considered too stupid to know what "Dred Scott" is.

As for me, I thought it was just funny. I mean, I used to not think we had to worry about Bush appointing pro-slavery judges, but now I not so sure. Consequently, maybe we need to rethink other issues that we took false comfort in thinking they had long since gone. Maybe we need to find out how Bush appointees feel about covered wagons and what should be done about train robberies. Maybe we need a litmus test on the issue of muskets. :)

9. Dred-Scott: See DU home page
Some people seem to be a bit boggled by Bush's Dred Scott remark last night. It wasn't about racism or slavery, or just Bush's natural incoherence. Here's what Bush actually said:

If elected to another term, I promise that I will nominate Supreme Court Justices who will overturn Roe v. Wade.

Bush couldn't say that in plain language, because it would freak out every moderate swing voter in the country, but he can say it in code, to make sure that his base will turn out for him. Anti-choice advocates have been comparing Roe v. Wade with Dred Scott v. Sandford for some time now. There is a constant drumbeat on the religious right to compare the contemporary culture war over abortion with the 19th century fight over slavery, with the anti-choicers cast in the role of the abolitionists.
