Disclaimer: This is the same incident as that in the post about reading the comments. I am using a different thread because the issue is different.

ST. LOUIS, MO (KTVI - FOX2now.com) - A man is dead after police say he tried to break into someone's house. The incident happened around 3:40 a.m. Monday in the 1900 block of East College. The homeowner told police a man and two females entered his home and tried to burglarize it. The resident shot the man and the two females fled. The suspect was shot in the chest and died at the scene. Police say the home had also been burglarized on Saturday and Sunday. Police say charged are not expected against the resident. The suspect is described as a 45 year old black male.

I am sometimes amazed at the utter stupidity of criminals. (I am assuming that it was the same burglar on each event. I consider that to be extremely likely, although not certain.) When a home is hit two nights in a row, one may reasonably expect to find an alert and angry homeowner waiting for you if you go back the third night.

The Stupid, It Kills. As Larry Niven's aliens (Known universe series) often say, "Stupidy is always a capital offense."

Would this qualify for a Darwin Award?

BTW - MO has Castle Doctrine Law.

5. If committing crimes are a capital offense, which ones fall under that statement?
Wall Street has criminals, can we kill them? GWB is a criminal can we kill him?

8. When a wall street banker (or GWB) break into your house at 4:30am..
.. you have every right to shoot them.

Until then? You might actually want to address 'the crime' in the poster's statement you responded to, rather than what those other guys did.

11. If the criminal is posing an imminent threat of serious injury or death then yes you can.

12. So I can kill both of them, as long as it is imminent, not necessarily acute.

4. They KNEW the homeowner was a gun owner - Presence of a gun emboldened them!
If there hadn't been a gun in the house, there wouldn't have been any reason to break into it.

" The suspect is described as a 45 year old black male."

In case anyone was wondering... It was not me... I was with my wife shopping at Lowes. The power tools were emboldening me to remodel a walk in closet.
