POSTED: 4:46 pm PDT May 28, 2009
UPDATED: 5:26 pm PDT May 28, 2009

LINDA, Calif. -- Yuba County deputies have arrested a Linda father after his 14-year-old son accidentally shot his 12-year-old son in the head.

Investigators said that on Monday, the son of 42-year-old Tou Her took his father's handgun and loaded it, then pointed it at his brother.

The gun went off and struck the younger boy in the head. However, he is expected to survive.

Her is facing charges of criminal storage of a firearm and felony child endangerment.

27. I rarely seem to get that reaction ...
many times, I get responses that are along the lines of "you're a sick person for making such a joke ..."

4. But we love our guns . . .
I doubt I'll ever log onto DU and not see an article about a kid being shot or other horrendous event. I don't get the gun love.

7. Yea ...no one ever posts all the articles about people defending themselves with a gun...
but there is a lot of gun defense info out there. It's just more sensational to post these kinds of articles to push an anti gun agenda by people here who don't care if it divides the DU community. It's about as fair as Fox news. Try reading some of these... http://www.claytoncramer.com/gundefenseblog/blogger.html I'm sure that those thousands of people who rightly used a gun to defend and protect themselves "love" their guns too. pffft

10. you mean you have never been to the gungeon?
those articles are posted all the time. as are ones like this one where a kid uses a gun for something stupid, or there is an accidental shooting. but it is a hot topic, and people here cannot discuss them without breaking the rules. so, we have a gungeon.

6. Every time I think about buying a gun
I think about what could happen and decide it's just not worth the risk.
Living with yourself after something like this happens would be nearly impossible. :(

11. My dad taught my brother and me firearm safety when we were 6 and 10 years old
Both of us own them, we store and use them responsibly, and neither of us has ever had a problem with them because of what our dad did.

He had been a rifle instructor toward the end of his career in the Navy. He served in World War II. We were taught correctly.

Unfortunately, most kids don't have a parent who is anywhere near as well qualified to teach them how to be safe around weapons. Basic gun safety should be taught in public schools.

15. Gun safety was taught in my school
It didn't prevent the one or two kids a year who died after getting drunk and playing Russian roulette.

23. Accidents like this are actually extremely rare.
It's just that, like child abductions, you tend to hear about it in the media, making them seem more common than they actually are.

12. "The gun went off "
but i thought that was impossible? the gun is an inanimate object ... it can't cause itself to shoot ... the trigger can't pull itself even if the safety is off, can it?

20. That would be media-ese for
"the person holding the gun pulled the trigger". No, guns do not "just go off."

21. pet peve of mine guess I am not the only one.
Trigger was pulled which released firing pin, which struck the primer, igniting the propelent, and firing the round.

The weapon worked exactly as it was designed.
The father on the other hand was defective.

16. I'm surprised there haven't been more "In Defense of Guns" posts.....

...... usually when something like this is posted, it's like a Bat Signal for the DU Gun Lobby to come running.

18. Maybe this will teach you something about people who own and use guns responsibly
There is no excuse for failing to secure a dangerous weapon from children and other unauthorized people.

19. Maybe because the vast majority of people that believe in protecting the 2A also believe
that people should be responsible with their firearms, and consider an incident like this (in which the law was apparently not followed and a child was hurt as a result) to be tragic.

And if you're going to have a go at the "DU Gun Lobby" for posting on threads like this, I assume you also recognize that many anti-2A folks on DU swarm to posts like these to make policy arguments as well.

22. Agreed. With great power comes great responsibility.
It doesn't just apply to spiderman. :)

If you own a firearm you are responsible for it.
If you are not responsible then you should suffer the consequences of your irresponsibility.
If you can't handle that then don't own a firearm.

24. You should see my son have a meltdown when someone points a gun near him.
Of course he is trained. He goes to great lengths to never point a gun at another person even by accident, loaded or not. And he makes it clear he doesn't want them pointed at him ever. He is 10.

26. The California Safe Storage Law
California has laws against this sort of incident. The Dad broke the law, and he will be prosecuted. Prior to the passage of the law he would have faced no charges.

That's Gun Control in action, one of the Gun Control laws I do agree with. Congrats.
