Kansas House Approves Machine Gun Bill

TOPEKA, Kan. -- Individuals could own machine guns, other fully automatic firearms, sawed-off shotguns and silencers under a bill the Kansas House has passed.

The vote Friday was 105-18.

The measure is the House's version of a Senate-passed bill meant to clarify state laws dealing with who can sell semiautomatic weapons to law enforcement agencies and officers. In December, the attorney general issued a legal opinion saying some dealers might be barred.

The Senate's version deals only with that issue. But in the House, a committee added amendments to remove the restrictions on individual ownership of other weapons.

The House's change will become an issue when the two chambers negotiate over the final version of the bill.

1. So considering Kansas and firearms and their stand on creationism...
the expression "Toto, I don't think we're in Kansas anymore" can now be reinterpreted into an expression of RELIEF. (sorry, blue Kansans)

3. It will never pass the NFA 1934 muster, period. These creeps know it.
You never know what to expect from the NRA gun lobby, but this isn't going anywhere.

8. depends if the NFA stays around much longer
the way they were talking in the supreme court we may have a new set of regulations dealing with machine guns- a bit less restrictive by the way Scalia was talking

14. No, it wont happen in our lifetimes, thankfully. "Heller" isnt going to do anything
to change national gun control laws at all.

16. Heller is not just a fad
that will blow away with the next gust of wind....it will set precident that lower courts will need to abide by. Most national laws will stay the same ill give you that...but some may change...the hughes amendment may be gutted, other states bans may be overturned. Chicago's handgun ban will be challeneged and most likely tossed out

this is all contingent on an individual rights ruling though- which to me and to most of america seems to be a given

Some used to say that concealed carry in a few states was just a fad.
They also said the Castle Doctrine would never fly.

Everyone knows that Kathleen Sebelius will not sign this type of legislation...her veto had to be overridden on Kansas CCW legislation even though it passed both chambers of the house with the support of both parties. I have been a little out of the loop while working tremendous hours, I'll try to see what this is about.


Kansas has always been a battleground state for social issues. Beginning with the fighting over slave v. free state...free won. John Brown, Carry Nation, womens suffrage, prohibition, Brown v. Board of Ed, abortion issues, creationism issues, the Phelps family to name a few..say what you will about Kansas, I have lived here for 1/2 of my life few states populations are as truly progressive as Kansas.

9. With numbers in the house like 105-18
I am not sure what movement is afoot but if the senate votes with similar numbers they could absolutely override. (47 Democrats and 76 Repubs in the Kansas House) plus a Dem governor. Gov. Kathleen Sebelius (D) has been a pretty good governor, my only disagreement is in her opposition to CCW against the will of much of her Democratic base. Kansas previous Gov. was Bill Graves (R) who vetoed a CCW bill without an override was very Progressive on other issues for a Repub.

Current policy is that States may have a more restrictive policy. This bill means Kansas (assuming it gets passed) will be at the Federal standard, not a more restrictive state standard. This is a good thing IMO.

Since private gun ownership is clearly a progressive thing, I hope Kansas follows its progressive history and liberalizes its unneeded firearms restrictions

7. I might just be naive,
but I don't see a lot of people in Kansas going out and buying fully automatics. Then again, I am not from Kansas. What do people in Kansas think the results would be if this is state law?

10. If NFA and 1986 FOPA was loosened
making it lawful for states to set their own standard and allowed for intrastate transfer of automatic weapons resulting in reasonable pricing for autos I think there would be quite a few, but no more than most other states.

11. I have drivin through Kansas a number of times
and frankly, they could give away free AK47's and I still wouldn't move there. There is a reason those of us from states that actually have topography call it the fly over zone.

13. I might suggest you are uncomfortable
with the ability to see so far in any direction and/or you have never ventured off of I-70 or I-35 (more likely).









Your characterization would be no different than me saying such a thing about the State of California based on my one trip to Oakland or Sacramento for that matter.

20. O.K. I was being kind of snarky and you are correct
I don't like horizon to horizon flatness. I grew up in San Francisco and hills and mountains are much more comfortable for me. You can climb a hill and take stock of where you are and, no, I didn't get off the interstate cause I didn't see anything different for as far as the eye could see.

Great Pics though. I love the Buffalo.

24. Everyone loves east coast sunrises and west coast sunsets
because of the unobstructed view of the sun rising/setting above the curvature of the earth. Out here on the prairie we have beautiful sun rises and sunsets, the prairie has much beauty which is overlooked by many who can't get past the vastness of limitless views. It is sort of a 'forest for the trees' effect.

12. Mere speculation..
Mike Hayden, former KS governor is the head of KS Wildlife And Parks. He has made sweeping changes in landowner rights resulting in the ability for landowners to sell to the highest bidder the wildlife which reside on the owners land. This has resulted in a huge business in out of state hunters coming to KS. Many of these hunters are wealthy as these hunts are pretty expensive. If they could range shoot autos while they are in the state it may attract even more alien hunters, again mere speculation. The down side of Hayden's changes is it is difficult to get permission to hunt. I used to be able to hunt just about any place simply for asking permission, now it is more difficult to find any place to hunt without having to pay big bucks. I wouldn't be able to afford to hunt if I didn't own my own land and have family land.

However, officials have to go outside Kansas to buy the devices because they are not legal for sale in the state. The new legislation was designed to address that.

The machine-gun issue was an amendment tacked on that applies only to collectible guns of a certain vintage, O'Neal said.

"This interest was brought about by high-end collectors," O'Neal said, noting that the weapons in question typically command $20,000 to $30,000.
