Judge threatens audience evictions at Westchester nuclear hearing

WHITE PLAINS, N.Y. - An administrative judge presiding at a federal hearing on the relicensing of the Indian Point nuclear power plants refused for several hours Monday to arrange for microphones that would allow the public and the news media to clearly hear testimony.

Instead, he threatened to evict anyone who complained.

When some in the audience shouted, "Can't hear," McDade sternly warned them to stop talking and said the arrangement would have to do. Michael Kaplowitz, a Westchester County legislator, then stood in the gallery and implored the judge to arrange microphones for the speakers, noting that the audience included members of the public, reporters and delegations from some members of Congress.

Gerry Shapiro, who was in the audience as a member of Sen. Hillary Rodham Clinton's staff, said she called the NRC to protest on Clinton's behalf.
