President Bush Nominates Judge John Roberts to Supreme Court
Urge Your Senator to Thoroughly Examine Roberts' Record

Only moments ago, President Bush announced that he is nominating Judge John Roberts to the Supreme Court. We urge Senators to fulfill their constitutional responsibility to examine Judge Roberts' record and determine if he has demonstrated the impartiality and independence neccesary for a lifetime appointment to the Supreme Corut.

If confirmed, Judge Roberts will have an enormous impact on the future of justice in our nation. He will affect the lives of all Americans not just for the remaining years of the Bush Administration, but for decades to come. Further, the new Justice will likely tip the balance of the court on an array of critical decisions. As a key swing vote on the Supreme Court, Justice O’Connor often provided the critical vote in 5-4 decisions. Many of the rights and protections that we have all come to cherish now hang in the balance. Advances made in civil rights, workplace protection, privacy rights, and environmental protections are now in jeopardy.

Alliance for Justice has laid out a clear set of standards that Judge Roberts must demonstrate, including an exemplary record in the law; a demonstrated commitment to protecting the rights and freedoms of all Americans; and an open-minded approach to deciding legal issues without political bias. No nominee is presumptively entitled to confirmation. Rather, because this very important appointment is for life, and because the Senate has a constitutionally mandated role in this process, the nominee and the administration bear the burden of providing clear and convincing evidence that he or she meets the qualifications.

This historic moment requires Senators to fully examine Roberts' record, and decide if he is a mainstream, independent judge deserving of a lifetime appointment to the Supreme Court. 1. John Kerry's letter

This much is clear already. Judge Roberts is no Sandra Day O'Connor.

Last night we learned that President Bush wants to replace a woman who voted to uphold Roe v. Wade with a man who argued against Roe v. Wade, and that sends a clear signal that this White House remains bent on opening old wounds and dividing America.

There are big questions that must be answered involving Judge Roberts' judicial philosophy as demonstrated over his short time on the appellate court. The Senate must learn whether he has a clear, consistent commitment to upholding Constitutional standards like civil rights, the right to privacy, and Roe v. Wade. These issues are in serious question if you take even a cursory glance at his record.

We need to ask the tough questions to determine whether John Roberts is the nominee who will give America a Court that is fair, independent, ethical and committed to Constitutional freedoms rather than an ideological agenda, and I promise you I will do everything in my power to assure that no question is sidestepped.

Throughout every step of the confirmation process, I will keep you informed about the questions that need to be asked, the answers we need to demand, and the principles we need to defend. It's impossible to overstate the importance of this moment.

2. The Record of John G. Roberts, Jr.: A Preliminary Report

This preliminary report provides a summary of the record of John Roberts, who has been a judge for less than two years, having been nominated by President George W. Bush to the United States Court of Appeals for the District of Columbia Circuit and confirmed in May 2003. In compiling this report, we have examined Roberts’s pre-judicial record as well as his limited record on the bench, focusing primarily on cases raising concerns with respect to civil rights and individual liberties.

Overview

Roberts’s record is a disturbing one. Among other things, Roberts is hostile to women’s reproductive freedom, and he has taken positions in religious liberty and free speech cases that were detrimental to those fundamental rights. Roberts has limited judicial experience, but even his short tenure as a judge raises serious concerns about his ideology and judicial philosophy. For example, dissenting opinions by Roberts have questioned the constitutionality of the Endangered Species Act and argued that Americans tortured by Iraq when it was a terrorist state can receive no compensation. This preliminary review of Roberts’s record indicates that it falls far short of demonstrating the commitment to fundamental civil and constitutional rights that should be shown by a Supreme Court nominee.

3. my "four a day" campaign

Aside from sending letters through every list which contacts me (NARAL, MoveOn, etc.), I've started calling my senators at the Houston and DC offices. I call it my personal "four a day" campaign: two senators, two cities. It takes fewer than 5 minutes, and I believe it may be more effective than just adding my name to yet another petition (which I'm doing as well).

Oh yeah--and I added the numbers to speed dial. :)
