Be careful out there! Got hit by a car/pinned between two cars in Houston today
I am in Houston visiting my daughter. I went to a local garage to get my oil changed. I was admiring a restored Kaiser next to the building while I waited. As I was standing by the driver's door peering in at the dash, a PT Cruiser backed into the Kaiser, pinning men between the cars. The PT was getting a brake job, and the mechanic never pumped up the brakes to set the calipers. He backed out of the garage and just kept rolling right down the slope into me and the Kaiser. I was smashed between the cars, yelling at the guy in the PT to pull forward, but hen just sat there staring at me in the rear view mirror.

He FINALLY eased the car forward. I collapsed to the ground. He got out, looked at me for am second, looked at the PT and said, "Damn it, now I have to replace a tail light and fix a bumper!," then he stormed off into the garage, leaving me laying on the pavement.

The shop owner ran out and got me to the hospital.

The door of the Kaiser was banged in pretty well, but that was all from me - not the other car!

Anyway, amazingly, nothing broken (on me) but my knee and leg hurt like hell.

I obviously have no use for the guy in the PT. Can you sue someone for being an asshole?

1. Dude, that's an ugly close call.
Glad you didn't get wrecked. If I was qualified to offer a legal opinion, I would, but I can say for that PT guy is an asshole.

2. Thanks...I was more scared than hurt, I think.
I have all the ER records, some photos, and I filed a police report just in case.

3. The garage should be responsible for any medical bills
that your insurance doesn't cover. I think their no-fault coverage should take care of all of that vs. your insurance (their coverage would be subrogated to yours). Will you be able to fly on your schedule?

What an idiot. And an asshole.

Stays showed no broken bones, and the walking part is getting better pretty fast. Have a pretty nasty abrasion, and a lot of bruising, but I think that's it.

I was lucky. The car that rolled into me wasn't moving too fast, and the car it pinned me against was an antique - built before they started putting a lot of reinforcing material in the doors. A late model car and I would have had a pair of broken legs at the least.

Not just for what he did to you, but the shoddy work on the PT.

Owner remarked that the guy was new and "obviously didn't know as much as I thought he did.". Also said, "no business can afford $#it like this."

That (ex?) mechanic was sub-human & very callous but the owner seemed to do everything right.

Glad you're okay. Take it easy on the shop--sounds like they did everything right. Keep records, and if anything else goes wrong (you'll be stiffer and hurting more in the morning, and that's when anything lingering will show up), call the owner back. If that doesn't get you far enough, call a lawyer. Chances are the owner will want to handle everything out of pocket to avoid raising his insurance rates, but if it gets expensive enough, he has insurance for that.

You could sue the idiot in the car, but he doesn't sound like the type to have amassed much of a fortune.

Nothing is broken or torn, I won't miss any work (was off for a bit anyway), and the garage owner paid all the medical costs. Barring any surprise complication, I don't think there is anything to be done to make me whole.

22. That's awful! I hope the ER gave you warning signs to watch for blood clots
in your legs. Trauma is one way they can form...and you don't want to have them get loose.
