Our insurance company wrote about the accident...


The company that owned the cherry picker denied the claim. They said that the driver was loading the cherry picker onto the truck and I ran into it.

I talked with the lady from the insurance company for a few minutes and I asked her:

1) Why would he need the stretch the cherry picker over 2 lanes of traffic?
2) Though there were emergency flashers on the truck that does not give him access to 2 lanes of traffic.
3) If he was going to be over 2 lanes of traffic why wouldn't he have signs up or someone directing traffic, especially at 6 in the morning?

She said the claim would be going to arbitration. She said it was pretty much a standard thing and they expect it to go their way. If it doesn't the only way we can win a claim against it would be to file suit ourselves.

2. To be honest...
A lot of people from work were encouraging me to sue after the accident. I wasn't horribly hurt (some muscle problems) and said that I wouldn't do it. I'd hate to think that now I have to.

Unbelievable. Maybe if you were drunk or texting? It is still amazing that you weren't horribly hurt.
