8. So her whole basis for her lawsuit is that the policy of Perez Hilton is to not post
the e-mail addresses of people who post COMMENTS on his blog, not those who send e-mails privately.

She's wasting the courts time, that'll piss off any judge.

She sent it on company time and on a company computer. If she sent it to the blogger then the blogger is free to post it on his website. She's screwed, and that's too bad. NOT!

It's one thing to wap an asshat on a board. It's quite another for an admin to "out" an asshat for the apparent purpose of soliciting direct e-bombs. This happens at DU, and I'm on record as being opposed to it.

12. I was thinking the same thing: that there's a legitimate privacy suit here.
That is, until I noticed that she used her work email... then I think it becomes a private matter between her and her employer. You have the right to free speech outside of your workplace (EVEN HATE SPEECH!), but once you step into your workplace, you leave the Constitution at the door.

Had Hilton contacted the employer to rat her out for using the company's e-mail system to send her crapola, that'd be one thing. But he engineered her harassment by many people, just as if he'd put up a billboard saying, "Diane Wargo hates gay people. Here's how to contact her" with her e-mail address.

I bet her attorney will stack the jury with people who aren't internet-savvy (assuming the case gets to trial) and she'll win the case — not the full $25 million, but something, and the repercussions will ripple throughout the blogosphere.



Unrelated to this discussion, but I don't understand this part:

16. No argument there, but
the courts shouldn't allow lawsuits based solely on "Turnabout is fair play."

Like I said, this will be felt throughout the blogosphere, regardless of the outcome. No one wants to be a defendant in a lawsuit, even if it's frivolous.

I wonder what Skinner's take on this would be.

18. I think there are a few on DU who wouldn't have any qualms about harming someone at this level...
based on a simple disagreement.

I think you're right - that the courts shouldn't permit public humiliation and calls to harassment on the Internet.

14. This also reminds me of when I first got on the Internet
I hanged out in a gay chat room, had a lot of friends, etc.

Anyway, we started getting bashed all day every day by this guy. He would bash from his home early in the morning,he would bash from work all day, then he would go home and bash us at night. It was really distressing. The ignore feature back then was not the greatest.This went on for weeks.

Anyway, this was circa 1995 and back before MSN and AIM everyone had ICQ. He had a very unusual screen name and just for the heck of it I did a search on ICQ and lo and behold,his name came up. I had his first and last name. His physical address. And his email address.

I copied and pasted all of this information and sent it to the basher via IM.

<blip!> He dissapeared and we never saw him again............
