Man Sues Florist Because His Wife Found Out About Affair
A Houston, TX. man is suing the florist company 1-800-florist because while the man was going to a divorce he had flowers sent to his girlfriend, but the florist company sent a receipt to his wife. After seeing the receipt the woman called the company asking for more information about the flowers and the company sent the wife the information. As a result, the wife increased the amount of money she was asking for in the divorce settlement. Now the man is suing 1-800-florist for mental pain and the increased amount he will have to pay in the divorce settlement. The lawyer and the man are saying 1-800-florist breached the contract the man had with the company by sending a recipt to his wife's house.

First, the lawyers handling this case should lose her liscence. Not because she took the case of a man that cheated on his wife. She should lose her liscence because she took such a frivolous case. I am not against lawyers taking the cases of people who do stupid or wrong things. However, this case is just stupid. The man should just grow up and take his lumps. If the florist sent the reciept to the wife's house than that had to have been the address on record for that man. If he was going to send his girlfriend flowers he should have changed the address of record instead of just telling the company not to send anything to a third party. The man's home or former home would not be considered a third party.

1. "As a result, the wife increased the amount of money she was asking for in the divorce settlement."
Was she originally asking for less than she was entitled to? Did she tell the court the reason for the increase? What does family law say about support payment amounts and the sending of flowers?

2. LOL! Most divorce attorneys will
tell you not to canoodle (at least openly) while you are divorcing.

If you canoodle with the STBE, it can be considered a reconciliation attempt and, in states with a separation period, restart your separation clock, delaying the time you can file for divorce.

If you canoodle w/ a third-party, as in the case here, the "injured" spouse can claim other stuff like "alienation of affection" and alla dat. It sounds dirty, but the wife is within her rights her, as he would be if the situation would be the opposite and she had the toy boy.

Weeee. divorce is fun! NOT. :P
