The bill was introduced in September by Rep. Chris Smith, for New Jersey, with 93 members of the House signed on as co-sponsors. The Unborn Child Pain Awareness Act (H.R. 6099) would define an unborn child at 20 weeks gestation as a “pain-capable unborn child.”

Abortionists would be required by law to tell mothers seeking abortions that there is evidence the child would suffer pain during the procedure. Mothers would have to be offered anesthesia for the baby and would be required to fill out a form indicating if they did or did not want the child to be anesthetized.

The measure would also call for the Health and Human Service Department to put together a brochure informing the public that “there is substantial evidence that the process of being killed in an abortion will cause the unborn child pain.”
