I have finished my very first outline for my very first legal memo.
(Well, faux-memo, anyway -- it's schoolwork.)

I now know way more than I'd like to know about rescinding a real-estate contract based on mutual mistake in the state of Vermont.

And I think the guy in my hypo is a whiny twit.

Whee!

:bounce:

3. Hypothetical scenario.
Said whiny twit wants to rescind a contract to buy a maple-syrup farm based on mutual mistake because less than .5% of the farm was showing signs of disease a month later. My argument: Sorry dude. There's no proof the disease was there at the time of the sale, the farm in general is still OK for maple syrup, a few hundred trees out of 10,000 is inconsequential (especially when the contract didn't specify #s of trees -- just approximations), and you didn't put anything in the contract to get you relief in case the agricultural expert you hired to inspect the property screwed up (so you assumed that risk).

4. Thanks, crim son!
I'm still waiting for the "law school sucks" thing to hit. So far, it's not been bad at all.

6. It'll only start to suck when you're really used to it.
And maybe not even then, if you've found your niche. I hope you have :)
