Prayers and/or good vibes desperately needed

LTwife and I are in a nasty custody dispute with her
daughter, Mary, concerning Mary's 1 yo daughter, Katie.
Mary has every right, for the time being, to custody.
However, since Katie was born, we have taken care of her.
Mary flits in maybe once a week or so. Up until now, no
problem. Yesterday, Mary shows up with the cops and takes
Katie. LTwife is heartbroken, worried if Katie is OK. You
see, Mary is a very irresponsible person, who signed costody
of Maddie, Katie's 3 yo sister over to us.

LTwife saw a lawyer, recommended by her Church, today.
It'll cost around 5 Grand, but he thinks, given Mary's
history, we'll pervail in court. But the hearing is on
Nov 7(great timing, huh?). Since we can't prove Katie in
in immenent danger, no TRO can be issued.

Vibes to LTwife and to Katie, please. Voodoo doll pins to Mary.

many witnesses will testify to Mary's behavior, including
several in LTwife's Church. We're talking Alabama here.
Law considers best interest of the child paramount.

You are posting in terms of characterizations. That is prudent.

However, nobody can really answer your question unless you describe, in detail, Mary's behavior. Therein lies the crux of the case.

It is unconstitutional for a state court to take a child away from a natural parent and give the child to a grandparent based upon a "best interests" standard.

The "best interests" standard only applies as between the two natural parents.

Mary couldn't handle the responsibility. IMO she still can't.
But, that's for the Court to decide. You're right, as pissed
as we are at Mary, she, too needs prayers/vibes. Right now, though,
our concern is Katie. Thanks. :)
