Does this seem fair?

Here's the quick background. A guy runs a website and a hacker gets in and causes serious problems to hundreds of websites on the server. But the Host is so mad at the guy, that they are thinking about charging him $20,000 for using PHPNuke software with an exploit in it. PHPNuke is very popular.

Does this seem fair?

Unless the server specifically bans the software in the agreement with its customers.
