AT&T Privacy Policy for AT&T Yahoo! and Video Services

Introduction



Conducting business ethically and ensuring privacy is critical to maintaining the public's trust and achieving success in a dynamic and competitive business climate. Privacy responsibility extends not only to protection of customer account information but to the privacy of conversations and to the flow of information in data form. Subsidiaries and affiliates of AT&T Inc. (the “AT&T family of companies”) understand that the trust of our customers necessitates vigilant, responsible privacy protections.



Scope



This Privacy Policy applies to AT&T Yahoo! customers (AT&T Yahoo! Dial, AT&T Yahoo! DSL, AT&T Yahoo! High Speed Internet U-verse Enabled, AT&T Yahoo! Small Business, and AT&T Yahoo! GeoCities) and their use of AT&T Yahoo! services, including AT&T Yahoo! Web sites. It also applies to AT&T Homezone and U-verse TV customers and their use of AT&T Homezone and AT&T U-verse TV services. (AT&T Yahoo!, Homezone, and U-verse TV individually and collectively referred to as “Service” or “Services”). It explains how the provider of your Service(s), as set forth in the applicable Terms of Service (individually and collectively referred to as “AT&T”), collects and uses certain types of information in order to provide you, the customer, with a more complete and more satisfying communications and entertainment experience, and the steps AT&T takes to safeguard your information. This Privacy Policy includes the AT&T Children's Privacy Policy, which applies to children's personal information collected on AT&T Yahoo! sites.



Please read this Privacy Policy carefully. Before using your Service(s), you must agree to this Policy. This Policy is available online at http://att.yahoo.com/privacy/.



AT&T Yahoo! customers: Please note that AT&T Yahoo! Services are provided jointly with Yahoo!. The use of information collected by AT&T Yahoo! through the provision of these Services is subject to both this Privacy Policy and the Yahoo! Privacy Policy. Yahoo! may treat your information in ways which differ from this Privacy Policy. Please consult the Yahoo! Privacy Policy if you wish to limit use of your information by Yahoo!. If you are a Homezone customer, part of your Service (AT&T | DISH Network) is provided jointly with EchoStar Satellite LLC and the use of information collected by EchoStar is explained in the Joint AT&T/EchoStar Privacy Policy.



Information we Collect



· Account Information. Account Information consists of Contact Information, Billing/User Information and Equipment Information. Account Information does not include any Usage Information.

o Contact Information. Information that allows someone to identify or contact you, including, for example: your name, address, telephone number, and email address. AT&T and its affiliates that provide you with Services obtain your Contact Information when you order and register for Services. Contact Information may also be publicly available from other sources.

o Billing/User Information. Includes information about your Services and account such as, Transaction Information, charges you have incurred (whether recurring or one-time), payments you have made, your Social Security number and/or credit card information, passwords and usernames. It also includes level of service (e.g., package subscription) and service history (e.g., service issues and resolutions).

o Equipment Information. Includes equipment IDs, serial numbers and equipment settings and software. This information may be associated with other Account Information.

· Diagnostic Information. Means detailed technical information about the operation of your equipment and your Services’ network security and performance characteristics. Diagnostic Information includes data such as memory consumption, feature usage (e.g., use of: parental controls, trick play features, recording functions, electronic program guide), firewall logs, response and latency times, packet loss, virus and worm indicators, IP addresses, port numbers, data speeds, and similar system information. Diagnostic Information may be associated with your Account Information and is collected automatically through your equipment and/or through the Service network.

· Transaction Information. Means information regarding a purchase made interactively through a Service.

· Usage Information. Means information about how you use the AT&T Yahoo! sites (e.g., IP address, the Web page from which you entered our site, pages you view, how much time you spend on each page, the links you click and other actions taken) when using your AT&T Yahoo! Services. Usage Information means information about viewing, game, recording, and other navigation choices that you and those in your household make when using Homezone or AT&T U-verse TV Services.

· Aggregated Information. Billing/User Information, Equipment Information, Diagnostic Information, Transaction Information and Usage Information may be aggregated (i.e. combined with other customers’ information). When aggregated, your information is not associated with your Contact Information or other information that would identify you individually.



How we use your information



* Account Information. AT&T uses your Account Information to initiate and provide your Services and to respond to your questions or problems. We use Account Information to bill you for your Services and for purchases made through your Services. We also use Account Information to communicate with you regarding service updates as well as offers and promotions for features and services, to personalize AT&T Yahoo! sites based upon your interests, and to exclude you from offers for services you may already have. Every marketing e-mail we send contains instructions and an opt-out link that will allow you to stop additional AT&T marketing e-mails based on line of business (e.g. business v. consumer). Note: AT&T Yahoo! customers must manage newsletter subscriptions or other e-mail communications from Yahoo! by modifying their AT&T Yahoo! Marketing Preferences.
* Diagnostic Information. AT&T uses Diagnostic Information to detect security breaches, to better market the Services to you and to others, for network planning and engineering, for quality control and product improvement purposes, and for technical troubleshooting purposes.
* Transaction Information. AT&T uses your Transaction Information for billing purposes and to determine which offers and promotions we will communicate to you. Your Transaction Information also helps us to enhance your communications and entertainment experience with customized content and advertising.
* Usage Information. AT&T uses Usage Information to personalize your Services, to recommend content, and to select advertisements or other promotions for you based upon your interests. Your AT&T U-verse TV equipment uses Usage Information to provide, tune and record content.
* Aggregated Information. AT&T uses Aggregated Information to troubleshoot technical issues, measure audiences, generate demographic profiles, analyze viewing trends and patterns, and for other marketing and research purposes.

How we share your information

* AT&T Family. The provider of your Service shares Account Information, Diagnostic Information, Transaction Information, and Usage Information within the AT&T family of companies in order to fulfill product and service orders, provide customer service, provide billing services, provide repair and maintenance services, and for marketing purposes.
* Third Parties. AT&T does not share your information with third parties, including advertisers, for their marketing purposes. We may disclose Aggregated Information to third parties including advertisers, content providers, market research companies, the NSA and other organizations.
o Service Providers. AT&T uses select third parties to enable all or part of your Services. These parties will receive certain Account Information, Equipment Information, Diagnostic Information, Transaction Information, and Usage Information. By contract, these parties may only use the information provided in order to provide Services, customer support, and product development and support.
o Transactions/Requests with Third Parties. You may choose to use your Service to purchase goods/services from third party providers. These providers may receive information necessary to effectuate the transaction or request (i.e., Transaction Information and Account Information). This Information may come directly from you or from AT&T (only disclosed upon your affirmative response to an offer).
o Contractors. AT&T uses third parties to help with some of our operations. These third parties may have access to Account Information, Diagnostic Information, Transaction Information, and anonymous Usage Information for a specific purpose (anonymous information is not associated with your Contact Information or other information that would identify you individually). For example, a shipping contractor may need your Account Information for shipping purposes, a marketing contractor may need your Account Information to communicate with you (via telephone, e-mail, or mail). By contract, these parties may only use the information we provide in order to perform specific tasks.
* Legal Obligations/Fraud. While your Account Information may be personal to you, these records constitute business records that are owned by AT&T. As such, AT&T may disclose such records to protect its legitimate business interests, safeguard others, or respond to legal process. Specifically, AT&T provides Account Information to collection agencies and/or credit bureaus. We may disclose your information in response to subpoenas, court orders, or other legal process, or to establish or exercise our legal rights or defend against legal claims. We may also use your information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of Service Terms or the Acceptable Use Policy, or as otherwise required or permitted by law.

How we safeguard your information

In order to secure the information AT&T collects, prevent unauthorized access, maintain data accuracy and ensure only appropriate use of information, AT&T has established appropriate physical, electronic and managerial safeguards. We require caller/online authentication before providing Account Information so that only you or someone who knows your Account Information will be able to access or change the information. AT&T uses various practices, including authentication, to secure your sensitive information. AT&T uses industry-standard methods such as encryption to protect data transmissions.

Additional Information for AT&T Yahoo! Sites



* Access by Children and Children's Privacy Policy. Your AT&T Yahoo! Terms of Service ("TOS") explain the terms and conditions under which you may establish sub-accounts. While the TOS require that members be 18 years or older, a member may establish a sub-account for a child under the age of 13 – provided that the member is the parent or legal guardian ("parent') of the child. AT&T uses the AT&T Yahoo! Family Account process to verify that a parent consents to our collection and use of personal information from their children and to their child's use of AT&T Yahoo! products and services.
o Information Collection and Use
+ When someone under the age of 13 attempts to create an AT&T Yahoo! account, we ask that he or she have a parent establish a AT&T Yahoo! Family Account in order to obtain parental consent.
+ When any user creates an AT&T Yahoo! sub-account, including a sub-account for a child under the age of 13, we require name, email address, birth date, gender, zip code, occupation, industry, and personal interests.
+ AT&T uses this information collected on sub-accounts to create and maintain accounts, for research, to customize the advertising and content seen on our pages and for other marketing purposes. AT&T will not contact children under the age of 13 about special offers or for marketing purposes without parental consent.
+ Under the Children's Online Privacy Protection Act (COPPA), no web site operator can require, as a condition of participation in an activity, that a child under the age of 13 disclose more information than is reasonably necessary. AT&T abides by this requirement.
o Ability to Update or Delete Information
+ Parents are allowed to review, edit, update, and delete information relating to their child's AT&T Yahoo! sub-account, at any time, by logging into the sub-account and accessing the Account Information screen(s). In addition, children may be permitted to review, edit, update, and delete information relating to their AT&T Yahoo! sub-accounts.
+ If a parent chooses not to allow us to further collect or use a child's information, parents enrolled in AT&T Yahoo! Family Accounts can delete their child's account by signing into My Account page and suspending the sub-account, the account will be deleted after 90 days.
+ Please note that information about a child may remain in back-up storage for some period of time after a request for deletion of that child's account. This may be the case even though no information about that account remains in our active user databases.
+ AT&T will happily address any concerns about our Children's Privacy Policy or inaccuracies regarding your or your child's personal information. You may e-mail us at privacypolicy@ATT.com, call us at 1-800-495-1547 or write to us at AT&T Privacy Policy, 175 E. Houston St., San Antonio, TX 78205.

* Use of Cookies. Cookies are pieces of information generated by Web servers and stored as text files in the user's computer, ready for future access. AT&T or a third party acting on AT&T’s behalf will use cookies to deliver 'user specific' web content and keep track of your online order activity. Cookies cannot pass on viruses, harm your computer or pass on private information such as an e-mail address without the user's intervention. Cookies contain session identification numbers, which allow our systems to recall previous sessions for authentication efforts and order information from our servers. Your browser can be configured to alert you when a site is attempting to send you a cookie and allow you to accept or refuse the cookie. On some Web sites, AT&T or a third party acting on AT&T’s behalf may use small bits of code called "one-pixel gifs," "clear gifs," or "web beacons" embedded in Web pages. AT&T allows other companies that are presenting advertisements on some AT&T Yahoo! pages to set and access their cookies on your computer. Other companies' use of their cookies is subject to their own privacy policies, not this one. Advertisers or other companies do not have access to AT&T cookies. Please visit the Network Advertising Initiative Web site to opt-out of network advertisers' cookies.

How you can review your Information

· Contacting Us. AT&T will address any concerns about applicable privacy policies or inaccuracies regarding your Account and Transaction Information. You can contact us at mailto:privacypolicy@ATT.com or write to us at AT&T Privacy Policy, 175 E. Houston St., San Antonio, TX 78205. If you request that certain parts of your Account and Transaction Information be changed, we will make any necessary changes.

· TRUSTe. AT&T is a TRUSTe licensee. TRUSTe is an independent, non-profit organization whose mission is to build user’s trust and confidence in the Internet by promoting the use of fair information practices. Because AT&T wants to demonstrate its commitment to your privacy, it has agreed to disclose its information practices and have its privacy practices reviewed for compliance by TRUSTe. The TRUSTe program covers only information that is collected through these Services, and does not cover information that may be collected through software downloaded from this Services’ Web sites. If you have questions or concerns regarding this policy, you should first contact us via e-mail at privacypolicy@ATT.com. If you do not receive acknowledgment of your inquiry or your inquiry is not satisfactorily addressed, you should then contact TRUSTe through the TRUSTe Watchdog Dispute Resolution Process and TRUSTe will serve as a liaison to resolve your concerns.

How we may change this Privacy Policy

AT&T wants you to be aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. If we decide to make a material change to this Privacy Policy, we will provide you with advance notice of at least 30 days (using an email address you created with your respective AT&T/SBC Service and by posting a prominent announcement on a Web site) so that you can determine whether to continue your Service(s). Please periodically check our sites for changes to this Privacy Policy.
