Why is one man's poison ok,the other sends you to jail?

It is a strange thing.

1. One is taxable, the other not

One was the poison of the aristocracy, the other was perceived to be used by "those people" who were pigmentally challenged. And then there's the whole issue of the newspaper magnate (Hearst?) who wanted to put the hemp industry out of business because of his ownership of papermills.

4. Marijuana isn't.

Since it's an illegal drug. Of course, you could argue that for that reason it needs to be legalized, but the feds can't do that without 100 years of egg on their face.
