Remember that letter I wrote to my landlord last week?

I ended up not including it with the rent check. Instead, I decided to write a new letter with a less belligerent and accusing tone. I figured, it wouldn't be a good idea to alienate the only person who can evict those animals upstairs from me!

Anyway, here's the letter I actually let my landlord see:


Dec. 7, 2003

To Webster Management:

The situation with my new upstairs neighbors in unit B-17 cannot continue. I have found the noise level up there intolerable from almost the very day that they moved in.

The worst of it is when they are having one of their semi-regular fights. During those periods, which occur approximately every week to ten days, they not only spend hours on-end screaming epithets at each other, but also stomping across the floor (and my ceiling) and, from what I can infer, throwing things as well.

On two separate occasions of which I am aware, they did not even bother to confine the arguments to their apartment. Rather, these incidents occurred when the man was upstairs in the unit and the woman was in the rear parking lot, thus exposing their antics to half the building. I distinctly remember the woman screaming up to her significant other, “I have to do everything in this fuckin’ relationship, you sorry son of a bitch!”

On four separate occasions in just the past month, I have found it necessary to call the police on those “people.” Most recently—-on Monday, December first--they woke me up two hours before I had to get out of bed and prepare to leave for my job. As a result, I was exhausted at work that day. And when I came home that evening, the noise upstairs prevented me from even taking a nap! By that time, their latest screaming match had long-since ended, but I was hearing other noises from upstairs, which suggested the dropping of bowling balls on their floor.

As if that weren’t enough, I subsequently learned from my next-door neighbor that the police returned to October Hills later on Monday the first because they had an arrest warrant out on the woman!

Surely, such self-absorbed, inconsiderate disregard for their fellow tenants is a blatant violation of Section 16(g) of the lease I (and presumably they) signed: “Improper or unnecessary noises or actions, unreasonably disturbing or molesting any other tenant or interfering with his rights, comfort and convenience are not allowed.”

Mind you, I wear earplugs to bed, but those “people” still manage to wake me up three to four times a week!

One of the reasons I have stayed at October Hills for the past four-and-a-half years is that Bert and his crew do an excellent job of maintaining the building and the grounds. However, if you are going to let such lowlife scum live here, I predict that all of Bert’s hard work will eventually be for naught. I appreciate that you need to keep the apartments occupied to generate income, but surely you don’t want to rent to just anybody?

Thank you for taking the time to read this. I only hope you are willing and able to attempt to resolve this problem soon. Otherwise, I will have no choice but to consider moving out of October Hills.

2. That's life in the big city! In one building I lived in, the gay couple
across from me would get into physical fights, the lesbian couple downstairs would get into emotional, brow-beating fights, and the heterosexuals in the building next door would fight so loud the police were called on occasion.

Can't we all just get along?????????????

4. I take it that the asexual folks upstairs are the only quiet ones.
It just goes to show that you should never rent an apartment where sex is allowed to happen.

So I can move any time I want. But I really don't want to move! Plus, coming up with the cash for a new place would be challenging at best.

You know what, though? Since I slid that letter under my landlord's office door on Sunday night, things have been much, much quieter upstairs. Perhaps he went up there yesterday and read those losers the Riot Act? I can only hope!

there is a clause in every lease that refers to the "right to quiet enjoyment" , mainly as a warning to the lessee to be quiet and not disturb the neighbors.

However, failure of the lessor to maintain the premises per the rems of your lease (maintain YOUR right to quiet enjoyment) is a material breach of your lease and as such, with proper written notice, you can notify your landlord of breach and actually serve THEM with a three day notice.(a three day notice actually is a document that says "you are in breach of the terms of our contract. Within three days cure this breach or notify me of your intentions" It is not, as many believe, a notice to move out in three days.) Sound fun?

If you are on a month to month lease, the terms are that of the last lease document you signed.
