Indian Burial Grounds?
Anyone have any information about what sort of legal schmegal is involved if burial grounds are found on your private property?

1. Check with your local history museum...
...or with a University Archeology Dept. I think, and it's been years since I took Archeology, that the burial ground does not, technically, belong to you. If it's an unregistered/unknown site I think you are required by law to report it's existance. Could be wrong though.

You usually need to report the site, but that's about it. You do not have to allow any excavation, and you do not lose ownership of the land.

Burial grounds are really only an issue if land is going to be developed. You won't be able to build your new house or business on top of it (well, not without consulting with the tribe to have it moved first), but other than that there is very little impact on the property owner.

FYI, my mother owns a few thousand acres in northern Nevada and has discovered two burial grounds on her property. Other than allowing the local tribes in to inspect the area, nothing really happened after they were discovered.

3. Depends on the state, county they're located in, and the deals with
the local tribes.
