Why do people use spyware?
Is it legal? Nobody ever seems to crack down on it.

1. targetted advertising
so far it's not illegal. And, in some cases, it pays developers so we don't have to. Not that such conditions make spyware good... but it keeps the cost of some popular software free.

2. It's usually legal
because you agree to it when you install whatever software bundle includes it. You know that 80 page end-user agreement you never read but click the box that says you do? There you go.
