Is a good story. And lets be having dozens of followups answering the questions posed.

But bouquets aside.

"Rubin was able to get the computer code through a fluke. The code was initially posted on a public Internet site and downloaded by concerned activists this year. Rubin and two doctoral students began analyzing the code this summer."

Fluke!!!!! And activists!!! Some people!!!!

There has been so much work done by so many people on this... and they call it a fluke. Morevover I am not an activist. And nor is Bev methinks, leastways half of her isn't.

Bev e is a tenacious investigative journalist with a soul of pure gold on the trail of the most important story since eve told adam he had no clothes on.

DU Rocks. Bev Rocks. The Internet Rocks......

I may be blowing my own trumpet a bit (touch wood) but I reckon this is the Internet news coup of the decade. Matt Drudge's scoop on Lewinsky is the last thing that would come close. When I saw the story in the NYT I started levitating. We have all waited so long for this story to finally move into the mainstream of the media flow. Greg Palast's outstanding work has even found it hard. But with Greg's solid gains over the past year I reckon the time is now ripe for this story to finally do what it always should have done, become the No. 1. political issue in America. The integrity of the voting system. Afterall without a voting system you can trust what good is democracy?

And when the dust finally settles Bev ought to have a pulitzer or 10 for this...... because if you listen very closely you can hear those walls are now a tumbling down....

The important point to note from these stats (as aluded to above) is that we have a long way to go to reach even half the people online that were reached with the first story let alone the millions who read the papers today.

On scoop anyway has only recieved around 10,000 views so far.. While this is good,it is a long way off 89,000 views. Hence the request re Yahoo..

Bev has also posted it to 8000 media outlets I understand. But they will do nothing unless the public are banging on their doors making them do something.

Bev's latest contains much more damning, much more important, and a far bigger clue as to where this story is going than all the 200+ and stories about this in Google News. At present the latst Diebold line is that the CE Operating system is the reason the machines work better.... (The reason this is so laughable a notion is likely to emerge shortly.)

In short this story isa roadmap of questions we want the media to start asking. And they will not thank us for asking them to do so.

That's why we need to drill down with Blogs, emails, letters and phonecalls.... until they realise that their own (that is, each individual media's) community will not be ignored.

From a journalistic and moral perspective this story I can understand a little of what the media is going through on this story. I went through the same process when Bev first emailed me. It is so hard to deal with this story because it is like waking up one day and finding your bedroom awash with filth.

As a journalist the democratic political processes are our raison d'etre, readon to be. It is through influencing voter opinion that the Fourth Estate finds its station.

And so this story, is figuratively speaking, like waking up and suddenly finding that your favourite park has a river of sewage running through it.

Journalists and editors are effectively being asked to disect the turds on behalf of the community so we can all decide how toxic they are then figure out what to do about it.

Yeah, it's now got legs, in large thanks to you and Bev. I think a good catch-all device to keep the attention of the press would be something like "the Diebold Challenge," a way of forcing them to put their money where their mouths are. I suggested something like this yesterday-- nudge them into letting a non-partisan group grab a random machine which has been in service and ship it off to an ITA they did not use previously for a thorough workout to prove all their claims. I lamented that one couldn't make a citizen's arrest on a voting machine. Maybe one can, with the help of the press. Might talk to Bev about it.

3. Great Idea... citizen's arrests on voting machines....
They would be a great stunt and everyone could do one... invite the local press and go visit the local election supervisor and make them take you to the machines :)

Yes, they have been quietly overwriting EVERYTHING, according to some information I got my hands on yesterday, dated May 2003.

The certified version of GEMS on the NASED site is 1.17.17, but they just slapped the 1.18 series onto all the Georgia machines (yet no officially posted list has this certified; I have no doubt it was recently recertified, though). The certified version on the touch screens was 4.1 but they just certifed 4.3 and slapped it onto all the touch screens.

What this does is wipe out what was on those machines during the elections.

However, their contention that the source code analyzed by the Johns Hopkins scientists was not theirs, or was badly out of date, or was not used in elections, will soon fall apart. (And I call your attention to the date they've been overwriting with new: that did exactly how much good re: the 2002 and 2000 elections, when they used the versions on their ftp site?)

I very, very seriously doubt that 1.18 and 4.3, respectively, have all those flaws cleaned up. Of course, we can't know because it's a secret...(sound familiar?)

So there is a plan for this, but the taking of a machine for examination isn't the simple answer. What they WILL have trouble with is trying to quarantine all the old CDs and memory cards which contain their programs and patches, which are scattered all over America.

11. Version changes?
Line-by-line comparisons would still show they didn't substantially change the code. One thing can be counted upon--they're greedy, lazy and stupid. Most of the faults would still be there. And, has anyone tested the machines after those changes? Run the stress tests? Done the fault analysis? Nope. Except maybe Shawn.... (yawn...).

On edit, changes in software require certification, yeah? Is Brit Williams a certified ITA? Nope. Requires re-certification, then, and not by bloody god Britain Williams. Yeah, yeah, yeah. Nail it. Collusion with the vendor, violation of Federal law, failure to meet state requirements. A software change requires recertification, period. Williams _cannot_ do this himself. Publicize it, go for it.

12. Publicize the versions and date of change...
... and make damned sure that there is mention that the versions installed in May, 2003, would wipe out any previous versions installed at the time of the 2002 election. Who did the changes, and how were those changes transmitted to the customers? CD?
Direct ftp? Floppies? What were the instructions accompanying the version update? How was the update announced? Did _all_ the updates undergo new certification? By whom? Were the ITA certifications delivered to customers before they were instructed to make updates?

Etc., etc., etc.

This is an extremely legit news angle on this story. And it could be a news story that is just a few paras long. Five even...

If we can provide contact numbers for media to phone sources. Then lets to it here and on Scoop. A proven formula.

If the sourcing is good on the upgrade work it is a the very very best... hugely inappropriate and looks like a shoddy coverup.

At best it will quickly become the key to the release of Diebold's real code version from Novemeber 2002.

That said. I wouldn't trust anything supplied by Diebold. So the circulating CDs etc... are needed anyway.

27. Anyone have the FEC Regs handy?
This news absolutely outrages me. If there's evidence of wrongdoing in the code, isn't this move obstruction of justice?

This move raises other questions as well. They have effectively destroyed the "evidence" of what software was actually on the machines in 2002. Isn't there a provision in the FEC regulations that election records can be destroyed after 22 months (and May wasn't 22 months), but does that apply to the software? It should. If not what records does it apply to?

Anyone have the FEC link handy for these regs? (I'm just not up to googling right now.)

I think it would be a good idea to have a thread for 2000 election and 2002 election problems, failures, etc.

Example:
2000 Election
Bay County, Fla.
Optical (Precinct)

THE POWER FAILURE THAT WASN'T

In Bay County's Precinct 23, more than 15 percent of all ballots were thrown out, the third-highest rate anywhere in the 26 counties. Sixty seven percent of the precinct's voters are registered as Democrats.

However, an examination of that precinct's audit tape, which lists power failures and machine malfunctions, showed the power had not failed. Bay County Election Supervisor Mark Andersen speculated that "bad pens" may have been used in the precinct, causing a high rate of ballots to be unreadable by the machine.

In most cases, election officials not only did not know why some precincts had much higher error rates than others, they were not concerned with finding out. Officials in most counties where those precincts were located said they had not examined their error rates or tried to identify the causes.

5. Wonderful post -- but gave me credit for a couple other peoples work
Diebold: The Face of Modern Ballot Tampering is a story by Faun Otter, who did some excellent research into Diebold's corporate ownership and vested interests.

The assertion that my story is at the top with Greg Palast's should say, instead, Kohno, Stubblefield, Rubin, Wallach's story is at top.

What I did, more accurately, was work with researchers to create the story "Inside a U.S. Voting Machine" which drew, as you say, hundreds of thousands, and ultimately attracted attention to those ftp files, which were then downloaded and examined by many.

Then, Kohno, Stubblefield, Rubin, Wallach examined the source code and wrote THEIR story and then I did a killer press blast providing additional resources to the media to make sure they covered it more widely.

Thanks for those links. Diebold made a couple bad mistakes in their response to this. Their latest official rebuttals, if correctly quoted in the press, will prove incredibly helpful to this story. Will dissect that AFTER exploiting the holes they just opened up. You'll see.

21. Thanks to my new friend
yes now I remember. I was so nervous. I am a painfully shy person and it was extremely hard for me to get the words out. I know Brian and I thought for sure he'd cut me off too soon. I don't have sound right now on my computer and even if I did I don't think I've got the guts to listen to myself. I got alot of support from other people here when it actually happened and they were wonderful.

Well since you didn't see it. Brian looked pissed off and bored with his subject choice of the day - what's up with the mooney's paper and Dick Cheney - and what story should be the lead.

And then you mentioned the NY Times article on electronic voting...

He sparks up, looks interested and he gave you a great deal of latitude while fiddling with the paper looking for the story. He might have held it up if he hadn't cut to a caller in texas. Do you think he cut you off>

While you were speaking he looked quite quizzical. It would be interested if his producer cut you off and not Brian. After you he went to someone from texas.

An interesting thought concerning the theoretical hacked Diebold smartcard "keys to the kingdom" that have been mentioned in article after article-- what would happen if suddenly said keys (or concise directions on how to create them) were to flood the streets? That is to say, some no-doubt unscrupulous persons were to actually manufacture them and pass them out on streetcorners, or instructions were to be posted on web sites and in internet forums, etc.

Florida 2000_Election Fraud - Ani Yun Wiya

I can conclusively prove that fraud was committed in the State of Florida in the year 2000 Presidential election. The proof has nothing to do with disenfranchisement. The proof has nothing to do with uncounted ballots. Anyone interested in this information?
