Question for attorney or paralegal:

(I can't find the legal eagle forum, so I'm writing this here. Mods, please put in correct forum if one exists better than this one.)

Questions involve power of attorney forms.

(1) Can you assign anybody power of attorney or do they actually have to have a license to practice law?

(2) Is there anywhere on the internet where I can download a power of attorney form that will be acceptable in Florida? This involves a very, very simple matter between siblings. Just want to give my hubby the poa to make selections in an estate distribution of low cost personal items.

2. 1) No, you don't have to be an attorney
2) Google "Florida Power of Attorney form" and you should be able to find plenty to download. I just did a brief search myself but everything I found so far wasn't free. However, there should be some free ones available if you look a little harder. I didn't go past the first page.

3. you might want to check out www.nolo.com
although i'd start by asking your probate court or other relevant government official your specific question, as specifics may be important. for instance, in many states, real estate matters are handled by a completely different type of poa.

the simplest solution is to not give your hubby the poa, just let him make the decisions and if you're not disputing them, simply present them as your own.

other than that, i have personally given mrs. unblock poa for a limited purpose, i called up the institution that needed it and asked them what to write. i didn't need a lawyer, but i did need to get it notarized. i.e., the recipient of the poa does not need to be a lawyer.
