"Ky. Court: Winner of '04 Race Can't Serve"
FRANKFORT, Ky. (AP) - After a year of legal warfare, voters finally have an answer to who won a disputed state Senate seat: no one.

The Kentucky Supreme Court ruled Thursday that the candidate who got the most votes can't serve because she didn't live in the district long enough, and the runner-up can't serve because she didn't win.

The result is that the 37th District Senate seat, representing part of the Louisville area, is vacant, as it effectively has been since the start of the 2005 General Assembly.

The court didn't recommend a solution, and Gov. Ernie Fletcher wouldn't say Thursday if he would call a special election to fill the vacancy. If nothing is done before the General Assembly convenes Jan. 3, Senate President David Williams can set a special election date.

1. Maybe that's what the SCOTUS should have ruled in the
National election in 2000! If you can't reach a decision on how to count the damn votes in Fl. then do the election OVER AGAIN!

2. That was my opinion.
I was so sick of it in 2k though I just wanted it to be over instead of the bickering and accusations Bush was tossing when he was the one acting like a sore loser.

3. Leave the Florida electoral voters' position vacant.
The constitution does not say that all states must participate in an electoral college. There have been three electoral colleges in which some states did not participate -- and in two of the three cases (1864 and 68) Florida was one of the states that did not participate.

So the proper decision would have been: if Florida cannot count its votes in time, hold the College without Florida.

The existence of this precedented response to the Republican sabotage of vote-counting in Florida is indirect evidence that some Supreme Court justices were parties to the Republican conspiracy to sieze power through the coup d'etat of 2000. That would (I submit) make them rebels under the 15th amendment, and thus ineligible to participate in public office until "reconstructed" by an act of Congress.

Bottom line: we have not had a legal president nor supreme court since 2000.

The runner-up up did win because she had the most votes of the legitimate candidates.
