VIDEO- Biden Says Declaration of Force Equiv to War Decl

Longer statement-Under the FISA law, there's an exception that the President can go ahead and bypass FISA temporarily IF a Declaration of War is declared. Biden says that the Declaration to Use Force is equivalent to a War Declaration. Still says Bush's position is bullshit.

I'll have to go find my John Dean book but I could swear he laid out in that book the argument that there has never been a constitutional declaration of war.

4. Congress declared war based on false evidence from the WH.
Don't take my word for it, just look at the redacted material from the SOTU speech Bush gave about Iraq before the war. Bottom line - you cannot spy on American citizens without a search warrant. It is part of the due process clause that the rule of law depends on. Without it, you might as well call America a dictatorship with very strong democratic tendencies.

7. At first I thought he might be getting a little nervous about Congress'
UNCONSTITUTIONAL GIVEAWAY of Congress' power to declare war TO BUSH, thus violating their OATHS OF OFFICE. This "equivalent" business is crap. Where does it say "a declaration of war OR ITS EQUIVALENT" in the Constitution? But I see he's just trying to create a King for purposes of war profiteering and oppression. That's our War Democrats.

And since when does a "declaration of war--if they had one for Iraq--create executive powers to ignore the law at will? That is more crap. Biden is full of crap.
