Well over a month ago my transmission broke. I took it to a mechanic of my sister's recommendation, and he farmed it out to a shop who took two weeks to fix it. Forty miles on the road, it started slipping badly again. I took it back, and they said the farm-out shop was not going to honor their work and redo the job they had not done correctly the first time. After messing around with it themselves for several days they said it was okay, but the fault appeared to be the rear brakes messing up and causing it to drag. Fine. I had just had the rear brakes COMPLETELY REPLACED about three months ago, so I took it back to the brake shop and had them inspect it. The brakes were fine, and according to them there's no way they could do what they were supposedly doing as far as breaking the transmission. Fine. The transmission broke again while on the highway, and I had it towed back to the original shop to make it right. They farmed it out to a DIFFERENT shop to rebuild it. That was two weeks ago. This morning I called them up (I had to let it ring thirty two times before they picked up) and it's still not ready. He won't call the farm-out shop up, and he won't give me a firm day or time it will be ready. The owner of the shop is out of the country (he's Iranian, and he had a death in the family.) His office manager has assumed responsibility, and during this morning's call he completely wussed out on making phone calls and finding out what was going on and when it would be fixed.
I'm out of money, and I've been sans wheels for over a month. What I need to know is, can I sue the original shop for lost income? I run an independent computer repair shop out of my home, and I have clients all the way to the state line (from Dallas). I've been unable to make calls on clients, and I'm starting to lose their confidence. At an average pay of $50 per hour, I'm losing a LOT of potential income.
This has gone beyond even my legendary patience. I'm out of time, and my bank account is at zero. Can I get legal satisfaction (and restitution) via the courts, or am I screwed?
