David Shuster said the recent Novak (Viveka) developments seem surreal.

He said that an attorney usually doesn't ask a question unless he already knows the answer before he asks. And normally, that answer would be something that would help his client. So it's pretty surprising that the Novak evidence didn't help Rove.

If you can't prove Rove was actively obstructing justice your perjury case is weak. The story would have to be, Rove very stubbornly didn't believe that he was a source for Cooper even though he was asked about it AFTER being told at Time they said he was. That he just didn't remember.

I'm sure Fitz decided he'd take double rather than risk nothing. Be thorough, get Viveca under oath, get corroborating evidence, and besides...
