ALITO: failure to recuse! Alito fails to uphold promise to SJC.
dKos bombshell... and the MSM is playing it down, of course.



A report in today's Boston Globe, buried on the last page of the second section of the front page, may just contain a smoking gun that Dems can use to reject the Alito nomination.

Under the headline "Plaintiff alleges Alito conflict," the report documents a case in which Alito failed to recuse himself, despite having a clear financial interest in its outcome.



Judge Samuel A. Alito Jr. ruled in a 2002 case in favor of the Vanguard mutual fund company at a time when he owned more than $390,000 in Vanguard funds and later complained about an effort to remove him from the case, court records show -- despite an earlier promise to recuse himself from cases involving the company.

1. I don't know what the law is on cases like this
but on the face of it, it looks really bad. I think people who are put in situations like this to recuse themselves to avoid even the appearance of impropriety.

but that doesn't seem to be the GOP rules which are more along the lines of "me mine gimme gimme"

6. Let's recap: Alito and Vanguard....
Cheney and Halliburton, Rummy and Tamiflu (which doesn't work on bird flu by the way), Neil Bush and (take your pick) Silverado, NCLB, * and Harken. Repugs exist to enrich themselves and their friends at the public troughs. Complete and utter abuse of power.
