2. Conspiracy by definition needs two people
there are always at least two people committing a conspiracy.

Sometimes, one is a conspirator but isn't indicted. Why? He might be turning evidence under a deal. He might be vice president and temporarily beyond indictment.

But the indictment has to allege that the charged person agreed with another person, who I guess can remain unnamed in the indictment and is therefore referred to as only a "unindicted co conspirator".

6. Vice Presidents of the USA are NOT beyond indictment
Presidents are, but the opinion from the Watergate years (prepared by Robert Bork as Solicitor General, no less) stated that while a Vice PResident can be indicted, a sitting president cannot.

It has never been tested in any court at any time as the Grand Jury at the time named Nixon as an "unindicted co-conspirator.

Spiro Agnew, however, was indicted by the state of Maryland on charges unrelated to Watergate.

7. My mention of the VP was gratuitous slam at him.
I don't know if he can be indicted, and in any event, all that really matters is if Patrick Fitzgerald thinks he can be indicted.
