I work for a pest control company. Yesterday, we heard from one of the other local companies that the local manager of a national pest control company is telling folks around town that we are being sued and will go out of business. We also got a letter yesterday notifying us of the suit, which we feel is bogus.
My question is, can we use the direct testimony of the individual who was told we were going out of business as evidence that the lawsuit was started to drive us out of business or harm our business? It's the manager's daughter who is suing us, claiming her kids were harmed when we did a termite job on their daycare-we did the job after hours, when no kids were there.
I told my boss to let his lawyers know about this, and really I just want to know if I did the right thing.
