White House Wants Search Limits Overturned

By MARK SHERMAN
The Associated Press
Friday, May 27, 2005; 11:22 PM

WASHINGTON -- The Bush administration asked a federal appeals court Friday to restore its ability to compel Internet service providers to turn over information about their customers or subscribers as part of its fight against terrorism.

The legal filing with the 2nd Circuit U.S. Court of Appeals in New York comes amid a debate in Congress over renewal of the Patriot Act and whether to expand the FBI's power to seek records without the approval of a judge or grand jury.

U.S. District Judge Victor Marrero of New York last year blocked the government from conducting secret searches of communications records, saying the law that authorized them wrongly barred legal challenges and imposed a gag order on affected businesses.

The ruling came in a lawsuit by the American Civil Liberties Union and an Internet access firm that received a national security letter from the FBI demanding records. The identity of the firm remains secret.

<snip>

This proposed policy change will chill online discussion, especially if DHS/CIA/FBI/NSA/etc. ever go off on a wild hair and start collecting data from here or elsewhere on the net, and then doing their corrupt thing. I'm on the net a lot, so I'm especially wary of anyone getting my ISP's records. How many others are spooked about this ?

2. Yup. I wish we knew who was targeted. I've heard that some boards
have had al Qaeda visits. Would be nice to keep the terrorists out. That just leaves the freepers though doesn't it?

And then of course we have to worry about the micro-army that Rumsfield is hot for. You know..turn somebodies whole internet system off when you please.

Too bad the WH was not filled with real leaders. It would be much easier to not have to worry every time some bit of news leaks out that power is being used for wrong purposes.

But having been a victim of a crime and not wanting terror attacks to repeat themselves - I'm not against investigation. How foolish would we be if the US had not gone after the financing and the means of communication for al Qaeda?

13. Nope. Been a victim of a crime. Want big policemen everywhere.
Just a thing that happens when you've had life experience other than the norm.

Do you know how many felons they catch simply because of store security cameras in local stores? They get the license plates.

I am not an ACLUer. Though I know nothing about this investigation. Perhaps the ISP provider wonder why their customers are being targeted. Perhaps there is some big brother attack on some politically democratic site and the provider wonders about intentions. We don't know. If that is the case it is bad. But we don't know what the investigation is about do we?

But in Canada the ACLU was against DNA testing of child molesters when a child had been kidnapped and murdered. They lost me there (though I am never a big fan of extremist points of view).

Sorry if that shocks you. I know the ACLU has done some great stuff. I support that. But not every single case.

12. Do you actually believe al Qaeda would visit internet boards?
In that case, why don't they just put up a neon sign saying al Qaeda appearing here for matinee performance today?

If they're on the internet, they're most likely loking for how-to sites, not chatrooms and message boards.

May have been a rumor about al Qaeda. But if it is true - why
shouldn't they be under investigation? They declared War!

17. Are they saying you will loose freedom of speech? Isn't this privacy
& the internet issue?

I say - if you leave your house by the internet - you are in a public domain. And though nobody has a right to know your name and address - police will at times.

I'm willing to give up that freedom so that 'nutbombs' the world over will get caught.

How do you feel about internet child porn makers & distributors? Go get em right! I just don't have information from this report to say that they aren't going after some criminal. If they are good! If they aren't going after a criminal but a blogger or someone whose opinion they don't like - then bad.

I need more info.

As to that - that is another issue. Called the Patriot Act. And yes - as soon as the US can get out of Iraq the better to undo the act.

5. Fact: we find and share truth via the web. They can't let the truth out
cuz it will expose them as the criminals and traitors they are. They will not give power up willingly. They will try anything and everything to stop the spread of truth.

Live a life you would be proud to have written about. Be a strong, responsible American citizen. Be loyal to the principles that you believe in. Do what you can to serve truth and restore America. Be creative instead of afraid. Just accept that they are evil and nothing is beyond them.

Know we are all gonna die someday and there is no such thing as security. Do not live in fear, or you let them win. Just live and work for your principles. Be at peace with yourself at the end of each day.

Stand with the real America. Know they have no bounds on what they will try to reach their goals. But know also, they cannot destroy your heart and mind. They cannot win.

If I fall, one will come behind me. They cannot win.
