Why I'm not too concerned about the nuclear option
I don't like to see the Constitution tampered with except when really necessary, but I think this is something that will come back to bite Frist and the Republicans in the ass. Bush's and other Republican's approval ratings are going down fast. I think that the American people will see this act as bullying the little guy and will only make things worse from a PR standpoint for the Republicans. This could help return the Senate majority to the Democrats and help in putting a Democrat in the White House. Yes, Bush will get some radical judges appointed, but the majority WILL eventually return to the Democratic party. Then it will be our turn to appoint judges without fear of being blocked by the Republicans. What goes around, comes around.

"President Frist".

3. If it does pass watch for pressure on Snowe and Collins.
They are "artful dodgers" and avoid taking heat for misrepresenting the needs and sympathy of Maine. They act liberal but caucus with the Republicans. If this passes, they will be hard pressed to avoid doing a Jeffords, at least, or a full party switch. If it's blocked and they're pivotal (which they will be in the case of a block), they they can stay in their little fantasy world of 'liberal Republican's' without switching.

This one is a real mind bender isn't it.

Excellent post.

5. Yes, I think it's mostly bullshit.
Almost everything the congress does is bullshit, and that which is
not bullshit is done at 1:00 in the morning with almost unanimous
consent, e.g. the "Patriot Act".

The "nuclear option" is more FUD for the proles.

20. I don't object to discussing it.
I do think it's worth discussing.
But I don't believe all the dramatic crap being acted out in Congress.
Why should I?

7. And...
... what did the current crop of radical judges do for Bush's selection in 2000? Want two or three more just like them on the high bench? And in the DC appeals court, where most issues regarding the government wind up?

This power play is about one-party rule for a long, long time. They intend to use this opportunity to retain power. One doesn't take away a necessary minority right unless one never intends to be in the minority again....

Cheers.

13. quite a bit, actually
This term might see 2-3 Supreme Court appointments, which will now be approved on a party line vote without the recourse of the filibuster.

And these USSC nominees won't be your standard brand of conservatives, either. These will be hardcore, far right nutjobs determined to dismantle any vestige of the federal government that benefits the proles. And it won't be 3 and a half years of hell - these are lifetime appointments that will do a huge amount of harm to our country and citizens.

9. I don't think Frist has the votes for it
There is a question of whether he will need more than the 55 votes for actual rules change. I am too lazy to look it up now. I doubt he even has the 55, or I think he would have gone ahead with it already.

After they get rid of the judicial filibuster they will move on to the legislative filibuster. Then they can not only stack the courts which are already repuke but, they will pass ANY radical right wing bill they wish. This is not to be taken lightly.

AND, why do you think the Democrats will EVER be in power again? The repukes own the evoting machine companies. They stole the last 3 elections and will continue to steal elections until the evoting machines are dumped. They will have right wing radical wacko nut job Jesus Freak judges on the SCOTUS, pass any and all bills they wish to pass and continue stealing elections. YOUR country, as you imagine it, is GONE.

17. The Silent Fallout
The unspoken major strategy here is to paint very traditionalist Democrats as "radicals." The so called "moderates" in both parties are expected to make ,an appearance on a white horse to save the day. However an examination of who these people are shows they are mostly conservative or cow-tail to the conservative factions of their party. It is important win or lose, to portray the effort to avoid judges of extreme judicial bent as the mainstream view of the overwhelming majority of the American people. We must not let this government or the opposition define our dissenting views as out of touch. This is very dangerous territory. Under the present congressional arrangement getting desirable candidates for the courts may be difficult, however, preserving judicial appointments who know they are representative of all the people and must be true to constitutional dictates is a paramount crucial ideal. Any give on this subject sets the precedence for future appointments and redefines what has been acceptable to American citizens. No nose under the camel's tent, please. We can not allow any so called compromises to weaken the bedrock of this republic.

18. It Won't Matter What The People Think After This
Those Supreme Court appointments are FOR LIFE!
They can award every disputed election to the Repugs!
The Congress can pass Patriot 2, HAVA 2, and whatever else they
need to ensure their permanent control.
