Scalia asked at NYU if he sodomizes his wife
Close to 50 NYU law students and members of the New York community lined the sidewalk outside of Vanderbilt Hall yesterday afternoon to protest Supreme Court Justice Antonin Scalia, who was being honored by a student-run law journal.

Scalia visited NYU to receive an honor from the members of the NYU Annual Survey of American Law , which is dedicating their 2005 issue to Scalia.

Scalia is the subject of controversy for his dissenting opinion in Lawrence v. Texas, in which he criticized the decision to overturn a law that criminalized sodomy. While on the court he voted for the right to desecrate the American flag, and against the right to abortion and the right to engage in homosexual sex.

Prior to the dedication ceremony, Scalia met with law students for a Q-and-A session in Tishman Hall. The Q-and-A had limited seating - the audience was chosen randomly from students who RSVPed - and was closed to the press, though the discussion was simulcast on a projector across the hall.

(snip)
In asking about Scalia's dissent in Lawrence v. Texas and his view that privacy is not constitutionally protected, Eric Berndt, a law student, shocked the crowd by asking, "Do you sodomize your wife?"

Scalia refused to answer the question while the crowd gasped and the administrators promptly turned off Berndt's microphone.

If this animal thinks there's no right of privacy and no right of sexual freedom, then people have a responsibility to ask him questions about his sexual activities...And he's obligated to respond.

6. Mr. Berndt may give offense to some but since Scalia's --
-- vote in Lawrence v. Texas presumed to tell OTHERS what they could or could not do with their genitals, it seems to me that Berndt's "immoral" question was no more offensive than Scalia's moralistically written opinion on the same act(s).

I say bravo for Mr. Berndt.

29. I second the bravo...
and would also ask him if he and his wife participate in the orgies he seems to advocate. Fucking pervert has no right to tell other people how to conduct themselves sexually, as long as they are consenting adults.

The government has no business in our bedrooms, or any other rooms of our homes we choose to use. As long as the acts are consensual, and between adults, the government can just butt out. Doesn't it seem strange that Scalia gives more rights to gun owners than to adults having sex? That's wrong, and a perfect example of Republican values.

You've GOT to be an attorney. I'd hire you in a flash.

Agree with you on those orgies. If it's none of my business what he does in groups of adults, it should be none of his what I do with only one adult.

Your point on gun owners vs. sexually consenting adults is magnificent. Thank you for saying that and pointing it out.

I'm glad you'd hire me, but I'm actually a great-grandmother, and dropped out of high school in my senior year. I never saw my lack of formal education as an impediment to learning, though.

I also used coarse language, but I'm just so tired of all the sanctimonious, self-righteous, rightwingers trying to dictate to the rest of us how to live. I hope more and more of us are willing to stand up to these bullies and stop letting them run our lives. I have my hands full just managing my own; my suggestion to them is that they do the same, and realize that the only life they have a right to make decisions for is their own.

17. Lawrence v. Texas: The case that "pushed me to the left"!
Scalia is apparently uncomfortable with others knowing whether or not he sodomizes his wife, yet thinks it is okay for consenting adults to be THROWN IN JAIL for what they do in the bedroom! Anybody who supports "sodomy laws" has no place in any position of authority, especially the Supreme Court.

I still remember hearing that the "sodomy laws" had been overturned, and how glad I was. Then, I heard Scalia's dissent where he talked about a "culture war." I heard that three Justices dissented: Scalia, Thomas, and Renquist. The right-wing three! Next, I heard right-wing activists and talk show hosts expressing outrage that consenting adults could no longer be thrown in jail for sodomy. They came out against the right to privacy. What kind of sick minds would be against protecting privacy rights? They exposed themselves for what they truly are that day, and I have been opposed to the right wing ever since!

Here are some links that the right-wing hates!

In Lawrence, KS:

In NYC:

Justice Scalia, do you sodomize your wife?

51. Unfortunately...
Such actions have consequences. I remember: I asked a far less loaded, but politically uncomfortable, question of a hospital scientific administrator at a "town meeting" once. (It had to do with parking for a new building going up). He answered the question smoothly, but within the next 8 months, I found myself out of a job.

I would bet that this kid just got himself blacklisted for life from most law firms, those that deal with the government at least. We might want to keep track of him in some way. He's a hero today, but is he simply going to be tomorrow's destitute and unemployed for daring to put Scalia on the spot?

56. Damn good question.
The question being why do you support crimminalizing acts that if performed by a man upon a woman, wouldn't even raise an eyebrow, but yet if 2 men or 2 women are doing them to each other, it's all of a sudden a "Crime against Nature".

And I maintain that even that should be a Civil matter, so if Nature feels wronged, let Nature bring suit.

63. a "Crime against Nature".?
A "Crime against Nature"?

If they are so worried about crimes against Nature, why do they want to allow drilling in ANWR, reduced laws against air and water polution, ... ?

84. Yeah, a "Crime against Nature"
That's what they used to call any sexual act that was incapable of creating a pregnancy.

IOW, anything sexual besides having a male orgasm in a Vagina, causing all those Sacred Sperm to go rush towards a poor, unsuspecting Ovum...

A married couple giving each other a hand job, or doin' the "69" was a "Crime agaisnt Nature".

And I thought we had come a long ways since then. Perhaps we had, but we're boomeranging our way back into the Dark Ages.

I hope Jeebus brings me a new Electra-Glide when we get there...

61. Geez, I knew an Eric Berndt
a few years ago, he said he was going to law school in the northeast.

God, I wonder if that was HIM. The Eric Berndt I knew WAS a really gutsy kind of guy, and a big liberal.

64. Right on for that student.
(Crossposted before I read this) If Tony thinks there is no right to privacy, why is he so zealously guarding his?

The way, there's a huuuge New Yorker article about fat Tony from a few weeks ago-- it went on 15 plus pages, I read sections but had a hard time giving all my time to it (so much for my discipline/interest). But anyhow, one thing stood out. He supposedly doesn't respect Sandra Day O'Connor because she's intellectually inconsistent-- whereas he's good friends with Ruth Ginsburg _because_ of her consistency. Yet, here in the same article (which has been documented elsewhere) is the scene where he gets a question from the student about Election 2000--

And rather than explain his position. He replies (paraphrasing) "It was four years ago, and we've had an election since then, so my response is 'Get over it'". Nice job Tony, hide from your own inconsistency. Where are the States' rights you so consistently supported?

I'll answer for you Tony-- they're in the trash can with your consistency, principles, and honor. Not only does Tony flout his credo, he doesn't have the guts to explain himself. Tony may be a smart guy, but he's a gutless coward.

68. Republican men only sodomize their mistresses, boyfriends, or
victims.

For the wives, it's strictly a rare, occasional missionary encounter done in the dark, and solely for the purposes of pro-creation.

73. Gawd. The look on Fat Tony's face must have been priceless.
It's a wonderful thing when the people get uppity with these arrogant RW fuckballs, and call them on their obvious hypocrisy. More pies. More impertinent questions, if you please.
