Need help re: Scalia quote for LTTE
I believe it's in some DUer's sig line. In any case, can anyone steer me to Fat Tony's statement regarding his belief that a finding of factual innocence is not enough to overturn a legally arrived at death sentence?

"Mere factual innocence is no reason not to carry out a death sentence properly reached."

It was in reference to the fact that appellate courts are not finders of fact, but exist, particularly in criminal cases, solely to correct the mistakes made by judges (ie. procedural or constitutional errors, not errors regarding the facts of the case).
