Uninsured patient sent home to Guatemala

A Stuart hospital on Thursday placed an uninsured and undocumented Mayan farm worker, whose medical treatment cost the hospital $2 million, on a plane back to Guatemala after receiving a judge's permission.

A Martin County circuit judge authorized Martin Memorial Medical Center to return Luis Alberto Jiménez, 31, to his native country after he spent 3 ½ years hospitalized with severe brain injuries suffered in a Florida car crash.

Federal law requires hospitals to provide emergency care to seriously ill or severely injured people regardless of insurance or immigration status, but it makes no stipulations about long-term treatment.

Florida Legal Services, an immigrant advocacy group, had expected to file an appeal Thursday. But before it could act, the hospital put Jiménez on an air ambulance shortly after sunrise and flew him to Guatemala City from Fort Pierce.

JoNel Newman, a Florida Legal Services attorney, said she was shocked by the hospital's action. (snip/...)
